Payment terms

Tuition fees, Application Fees and any other applicable charges must be paid in accordance with the payment schedule issued by La Xenia. Students will only be permitted to commence or continue their studies where all required payments have been received in accordance with the applicable payment terms, unless an alternative written payment agreement has been approved by La Xenia.

The standard Application Fee is CHF 500, unless otherwise stated in writing by La Xenia. The Application Fee is non-refundable and non-transferable under all circumstances.

Unless otherwise expressly stated, tuition fees cover academic tuition only and do not include textbooks, learning materials, examination fees, graduation fees, the Service Fee / Housing Package, travel expenses, visa costs or any other personal or third-party expenses.

Service Fee and Housing Package

Students participating in an on-campus programme for which residential services are required must pay the applicable Service Fee in accordance with the payment schedule issued by La Xenia.

The Service Fee covers the student’s Housing Package for the applicable academic period. Unless otherwise stated in the student’s offer, invoice or programme documentation, the Housing Package comprises a bed or place in designated student accommodation, the applicable meal or food provision, health insurance coverage provided as part of the package for the applicable academic period, and the applicable airport pickup service.

The Service Fee is separate from tuition fees and is compulsory for students subject to the residential accommodation requirement. Payment of the Service Fee authorises La Xenia to reserve accommodation capacity and associated services for the student. The Service Fee remains payable irrespective of whether the student ultimately uses all components of the Housing Package, subject only to the refund provisions expressly stated in these Terms and Conditions and any rights that cannot lawfully be excluded.

Students and/or the paying partner are responsible for ensuring that the full invoiced amount is received by La Xenia. All bank charges, intermediary bank charges, payment processing fees, currency conversion costs and any exchange rate losses shall be borne entirely by the student or the paying partner. Any shortfall resulting from bank deductions or currency fluctuations remains payable and must be settled before enrolment or continuation of studies.

Payments must be made using the payment methods approved by La Xenia. La Xenia reserves the right to reject or return payments made through unauthorised methods.

Failure to make payment by the applicable deadline may result in suspension of access to classes, online learning platforms, examinations, academic records, transcripts, graduation or other student services until all outstanding amounts have been paid in full. La Xenia further reserves the right to suspend or terminate a student’s enrolment where fees remain unpaid.

Payments made to La Xenia are not transferable to another student or programme unless expressly agreed in writing by La Xenia.

Complaints

La Xenia is committed to providing a fair and transparent complaints process.

Students who wish to raise a concern should first seek to resolve the matter informally with the relevant department. Where this is not possible, complaints should be submitted in accordance with the La Xenia Complaints Procedure.

All complaints will be considered fairly, objectively and within a reasonable timeframe.

Refund policy

No refund or credit will be provided where a student voluntarily withdraws from, cancels, postpones or otherwise elects not to commence or continue their programme after payment has been received, except where expressly stated in this Refund Policy or where required by applicable law.

Application Fees are non-refundable and non-transferable under all circumstances.

Where a refund is approved, payment will be made only to the individual, organisation or authorised partner that originally paid the fees to La Xenia. La Xenia will not issue duplicate refunds or redirect refunds to another party unless required by applicable law.

La Xenia aims to process approved refunds within forty-five (45) calendar days after receipt of all required supporting documentation. Processing times may be extended where additional verification is required or due to circumstances beyond La Xenia’s reasonable control.

Approved refunds shall not accrue interest under any circumstances.

La Xenia reserves the right to deduct any outstanding tuition fees, administrative charges, library fines, disciplinary fines or any other amounts owed by the student before processing any approved refund.

Once La Xenia has delivered educational services, including but not limited to teaching, supervision, assessments, access to learning materials, online platforms or other academic services, the corresponding fees become earned by La Xenia and are non-refundable except where required by applicable law.

La Xenia reserves the right to request any additional documentation reasonably required to verify a refund request before approving or processing any refund. 

Online and Flexible Learning Programmes

Students enrolled in online, flexible or modular programmes remain financially responsible for all modules that have commenced or have been completed.

Where a student withdraws before completing their programme, no refund will be issued for any module that has already commenced, been accessed, delivered or completed, regardless of whether the student subsequently graduates or chooses not to continue their studies.

Only tuition fees relating exclusively to modules or educational services that have not yet commenced and have not been made available to the student may be considered for refund, solely at La Xenia’s discretion or where required by applicable law.

Where tuition fees are paid on a module-by-module basis, payment for a module becomes non-refundable immediately once teaching has commenced or access to learning materials, assessments or online learning platforms has been provided.

No Partial Refunds

No partial refunds will be issued for partially completed modules, partially attended teaching periods, partially accessed learning materials, partially used educational services or partially completed programmes, unless expressly required by applicable law.

Service Fee / Housing Package Refunds

Once the Service Fee has been paid, La Xenia may reserve a bed or place and associated residential services specifically for that student. Accordingly, the Service Fee is non-refundable and non-transferable upon receipt by La Xenia, except in the case of an eligible visa refusal meeting all requirements of the Visa Applicants section of this Refund Policy, or where otherwise required by applicable law.

The Service Fee remains non-refundable where a student subsequently withdraws from or postpones their programme; decides not to travel to Switzerland; fails to commence their studies; arrives late or leaves early; chooses not to occupy the designated student accommodation; wishes to reside with relatives, friends, partners or any other third party; arranges alternative private accommodation; does not use some or all meals, insurance, airport pickup or other services included within the Housing Package; is suspended, dismissed or expelled; or otherwise fails to make full use of the Housing Package.

Students acknowledge that accommodation capacity and associated services are reserved specifically for enrolled students and that La Xenia may incur binding commitments to accommodation and service providers once a place has been reserved. A student’s subsequent decision or inability to use the reserved accommodation or associated services does not release the student from the Service Fee and does not create any entitlement to a refund, credit, reduction or transfer, except as expressly stated in the Visa Applicants section or where required by applicable law.

A student’s decision not to attend classes, access learning materials, participate in assessments or otherwise utilise educational services does not entitle the student to a full or partial refund.

Commencement Date

Students who fail to commence their studies on the confirmed programme commencement date or otherwise fail to participate from the scheduled start of their programme, regardless of the mode of study, shall not be entitled to compensation, fee reductions, refunds, replacement teaching or any other remedy in respect of classes, learning activities or academic content missed as a result of their absence. 

Third-Party Payments and Refunds

Where tuition fees, deposits or any other payments have been made to an education agent, learning centre, recruitment partner, authorised representative or any other third party, La Xenia shall not be responsible for refunding any amounts that have not been received directly by La Xenia.

Students acknowledge that any payments made to a third party are subject solely to the contractual relationship between the student and that third party.

La Xenia shall not become a party to any dispute between a student and an education agent, learning centre, recruitment partner or any other third party relating to tuition payments, commissions, service fees, consultancy fees, contractual obligations or any other financial arrangements.

Where La Xenia approves a refund under this Refund Policy, La Xenia’s liability shall be limited solely to tuition fees and other amounts actually received by La Xenia.

La Xenia shall not be liable for any commissions, administration fees, consultancy fees, recruitment fees, bank charges, currency conversion losses, payment processing fees or any other amounts retained or charged by a third party.

Where payment was made through an authorised education partner, learning centre or recruitment agent, any approved refund will be issued only to the original payer unless otherwise required by applicable law or agreed by La Xenia in writing.

Visa Applicants

Students requiring a visa may be considered for a refund of eligible tuition fees and, where applicable, the Service Fee only where all of the following conditions are satisfied:

• all tuition fees and applicable charges have been paid in full;
• La Xenia has received the official visa refusal notice issued by the relevant immigration authority;
• the refusal is not attributable to any action, omission or circumstance caused by the student.

Satisfaction of these conditions does not automatically entitle the student to a refund. All refund requests remain subject to this Refund Policy and any applicable legal requirements.

La Xenia does not guarantee the approval of any visa application. The assessment and decision regarding any visa application rests solely with the relevant immigration authority.

The student remains solely responsible for:

• submitting a complete and accurate visa application;
• providing all requested documentation;
• complying with all embassy and immigration requirements;
• attending interviews, biometric appointments or other appointments where required;
• meeting all published deadlines;
• responding promptly to requests from immigration authorities;
• providing truthful, complete and accurate information throughout the application process.

Accordingly, no refund will be provided where a visa application is refused due to circumstances attributable to the student, including but not limited to:

• failure to submit requested documentation;
• submission of incomplete, inaccurate, misleading or fraudulent documentation;
• failure to comply with immigration procedures;
• failure to attend interviews or biometric appointments;
• failure to respond to requests from immigration authorities;
• failure to meet published deadlines;
• providing false or misleading information;
• previous immigration violations;
• withdrawal or abandonment of a visa application;
• choosing not to submit a visa application after enrolment;
• any other act or omission by the applicant which contributes to the refusal.

Where a visa refusal is subject to appeal, review or investigation by the relevant immigration authority, La Xenia reserves the right to defer consideration of any refund request until the matter has been finally determined.

La Xenia accepts no responsibility for visa decisions made by immigration authorities.

Once a visa has been granted, no refund will be issued if the student subsequently decides not to commence or continue their studies.
No Refund for Visa Delays

A visa delay or late visa issuance does not postpone, suspend or reduce the student’s financial obligations to La Xenia.

All tuition fees, Service Package fees and other applicable charges remain payable in accordance with the student’s agreed payment schedule.

Where such fees have already been paid, no refund, partial refund, credit, fee reduction or compensation will be provided because of a visa delay or late visa issuance, including where the student:

• cannot enter Switzerland by the expected arrival date;
• misses part of the academic study period;
• cannot occupy their reserved accommodation;
• does not use some or all accommodation, meals, health insurance, airport pickup or other components of the Service Package;
• participates in classes online rather than physically in Switzerland;
• receives their visa only after the programme has commenced; or
• otherwise receives less physical use of the accommodation, academic facilities or Service Package because of the delay.

Students acknowledge that La Xenia may reserve accommodation capacity, academic capacity and third-party services in advance and may incur financial commitments regardless of whether the student is physically present in Switzerland.

Limited Exception — Qualifying Visa Refusal

For visa students, the Service Package fee is refundable only in the case of a qualifying official visa refusal, subject to all requirements of La Xenia’s Visa Applicants Refund Policy.

To qualify for a refund of the Service Package fee on the basis of visa refusal, the student must, at a minimum:

1. have submitted their complete visa application at least 120 calendar days before the official commencement date of studies;
2. have submitted all documents and information required of the student correctly and completely;
3. have provided accurate, genuine and non-fraudulent information and documentation;
4. have complied fully and within the required deadlines with all requests, appointments, interviews, biometric requirements and other procedures imposed by the competent authorities;
5. have taken all reasonable steps required of them to progress the visa application; and
6. have received an official visa refusal for reasons not attributable to any act, omission, delay, error, non-compliance, misrepresentation or failure on the part of the student.

The student bears responsibility for demonstrating that these conditions have been satisfied and must provide La Xenia with the official visa-refusal decision and any supporting documentation reasonably requested for the purpose of assessing refund eligibility.

If the complete visa application was submitted fewer than 120 calendar days before the official commencement date of studies, the Service Package fee is non-refundable even if the visa is subsequently refused.

The Service Package fee is also non-refundable where the refusal results wholly or partly from incomplete, inaccurate, incorrect, inconsistent, fraudulent or insufficient documentation or information supplied by the student; failure to comply with an authority’s requirements; missed appointments; failure to provide requested information or documents; failure to complete required procedures; abandonment or withdrawal of the visa application; or any other circumstance attributable to the student.

A pending application, delayed decision, prolonged processing period, administrative hold, request for additional documents, delayed appointment, delayed permit issuance or late visa issuance does not constitute a visa refusal and does not qualify for a Service Package refund.

The fact that the visa remains undecided on or after the programme commencement date does not convert the delay into a refusal and does not create a right to a refund of the Service Package fee.

Currency Exchange and Banking Charges

Unless otherwise determined by La Xenia, all refunds shall be processed in Swiss Francs (CHF).

Any loss resulting from exchange rate fluctuations between the original payment date and the refund date shall be borne entirely by the student, partner or original payer.

The amount ultimately received by the original payer may therefore differ from the amount originally paid due to currency exchange rate movements.

All bank charges, intermediary bank charges, correspondent banking fees, payment processing fees, overseas transfer fees, currency conversion costs and any other charges associated with issuing a refund shall be deducted from the refund amount or otherwise borne by the original payer.

La Xenia shall not be responsible for any financial loss arising from exchange rate fluctuations or banking charges incurred during the refund process.

Completion of Refund Obligation

La Xenia’s obligation to issue an approved refund shall be deemed fulfilled once the refund has been successfully initiated through La Xenia’s banking institution or authorised payment provider.

La Xenia accepts no responsibility for delays caused by banks, intermediary financial institutions, payment providers, foreign exchange providers, overseas transfers, government authorities, compliance checks, public holidays or any other circumstances outside La Xenia’s reasonable control.

Force Majeure

La Xenia shall not be required to provide refunds arising solely from events beyond its reasonable control, including but not limited to natural disasters, pandemics, epidemics, war, terrorism, industrial action, government restrictions, border closures, travel disruptions, airline cancellations or other events constituting force majeure, unless otherwise required by applicable law.

Refund Exclusions

Without limitation, no refund will be provided in the following circumstances:

• voluntary withdrawal from a programme;
• cancellation or postponement requested by the student;
• failure to attend classes or participate in learning activities;
• failure to access online learning materials or digital platforms;
• dismissal or expulsion due to disciplinary or academic misconduct;
• failure to satisfy academic progression requirements;
• visa refusal resulting from the student’s own actions or omissions;
• withdrawal or abandonment of a visa application;
• failure to submit a visa application;
• failure to enrol after a visa has been granted;
• completed or commenced modules;
• educational services already delivered by La Xenia;
• Application Fees;
• bank charges, payment processing fees, intermediary bank charges or currency conversion costs.

Acknowledgement

This Refund Policy forms an integral part of the La Xenia Terms and Conditions of Enrolment.

By accepting an offer of admission, enrolling in a programme or paying any fees to La Xenia, the student and/or original payer acknowledges that they have read, understood and agreed to this Refund Policy.

Scholarships

Students who receive scholarships or tuition discounts must comply with any conditions attached to the award.

Where a scholarship recipient withdraws from their programme before completion, La Xenia reserves the right to withdraw the scholarship and require payment of the applicable standard tuition fees, subject to the scholarship agreement.

Liability

La Xenia accepts no responsibility for the loss, theft or damage of personal belongings brought onto its premises or used during any La Xenia activity, except where liability cannot be excluded by applicable law. 

Programme Adminsitration

Students who fail to enrol or who do not commence or complete their programme in accordance with the applicable academic regulations may have their enrolment withdrawn.

Requests to defer the commencement of a programme should be submitted in writing to La Xenia as early as possible. Approval of any deferral is at the discretion of La Xenia and may be subject to administrative charges and any applicable fee adjustments.

Force majeure

La Xenia shall not be liable for any delay, interruption, suspension or failure to perform any of its obligations under these Terms and Conditions where such delay, interruption or failure arises from events or circumstances beyond its reasonable control.

Such events include, but are not limited to:

• natural disasters, including earthquakes, floods, storms, wildfires or other severe weather events;
• pandemics, epidemics, public health emergencies or outbreaks of infectious disease;
• war (whether declared or undeclared), armed conflict, terrorism, civil unrest, riots or acts of violence;
• industrial action, strikes, lockouts or labour disputes;
• acts or omissions of governments, public authorities, immigration authorities or regulatory bodies;
• changes in legislation, regulations or government policy;
• border closures, visa restrictions, travel bans or other immigration measures;
• interruption or failure of utilities, telecommunications, internet services, information technology systems or cyberattacks;
• transportation disruptions, airline cancellations, airport closures or significant travel delays;
• failure or interruption of services provided by third-party suppliers, contractors or service providers;
• shortages of staff, facilities, equipment or essential resources arising from circumstances beyond La Xenia’s reasonable control; or
• any other event or circumstance beyond the reasonable control of La Xenia that materially affects its ability to deliver programmes or services.

Where reasonably practicable, La Xenia will take appropriate steps to minimise the impact of any Force Majeure event and will endeavour to notify affected students as soon as reasonably possible.

During a Force Majeure event, La Xenia reserves the right to make reasonable changes to the delivery of programmes, teaching methods, timetables, assessment methods, examination arrangements, academic calendars, locations or other services where necessary to ensure the continuation of education or to comply with legal, regulatory or public health requirements.

La Xenia shall not be required to provide refunds, compensation, damages or other financial reimbursement arising solely from a Force Majeure event, except where required by applicable law.

Nothing in this clause shall exclude or limit any rights that cannot lawfully be excluded under applicable legislation.

Enrolment

Students are required to complete the official enrolment process and provide all requested documentation before admission can be confirmed.

Applicants requiring a student visa may be asked to submit additional documentation in accordance with the immigration requirements applicable at the time of application.

An enrolment will only be considered complete once all required documentation has been received and any applicable fees have been paid.

• Complaints
• Insurance

Where health insurance is included within a student’s compulsory Housing Package, La Xenia will arrange the applicable health insurance coverage for the period specified in the student’s programme documentation or other written information issued by La Xenia.

Students must provide all information and documentation reasonably required by La Xenia or the relevant insurer to arrange, activate or maintain such coverage and must comply with the terms and conditions of the applicable insurance policy. La Xenia may request evidence of any additional insurance coverage for which the student remains personally responsible.

Students remain responsible for any insurance requirements, periods of coverage, risks, services, deductibles, exclusions or costs not expressly included within the Housing Package, including any insurance required before La Xenia-arranged coverage begins, after it ends, or outside the applicable academic residence period.

• Programme cancellation

Examination Fees

Unless expressly stated otherwise in writing by La Xenia or in the official programme information, tuition fees cover academic tuition only and do not include examination fees, external examination charges or any costs associated with assessments conducted by external awarding bodies, accreditation organisations, professional bodies or examination providers.

Students are responsible for paying all applicable fees relating to examinations, reassessments, resits, external moderation, professional registrations, certification, transcript issuance, graduation, qualification verification or any other charges imposed by external organisations or awarding bodies, unless these are expressly included within the published tuition fees.

Where a student is required to repeat an examination, assessment, module or any component of their programme, any associated fees, including administrative charges or external examination fees, shall be borne by the student unless otherwise determined by La Xenia.

La Xenia reserves the right to amend examination fees or collect additional charges where external awarding bodies, accreditation organisations or examination providers revise their published fees. Where applicable, students will be notified of such changes as soon as reasonably practicable.

Payment of any applicable examination or assessment fees may be a prerequisite for examination entry, release of results, issuance of transcripts, award of qualifications or graduation.

Changes to Programmes and services

La Xenia reserves the right to make reasonable changes to its programmes, curriculum, modules, specialisations, teaching methods, assessment methods, delivery modes, academic calendars, timetables, facilities, campuses, locations, lecturers, learning resources, online platforms or any other academic or administrative services where such changes are considered necessary or desirable for academic, operational, regulatory, quality assurance, accreditation, legal, financial or other legitimate institutional reasons.

Such changes may include, but are not limited to:

• modifying module content or learning outcomes;
• updating programme structures or curricula;
• changing lecturers, supervisors or other academic staff;
• altering timetables, teaching schedules or academic calendars;
• changing teaching locations or campuses;
• delivering programmes or individual modules through online, blended or alternative delivery methods;
• modifying assessment methods or examination arrangements;
• replacing, withdrawing or introducing modules, specialisations or elective options;
• updating policies or academic regulations to comply with legal, regulatory or accreditation requirements.

La Xenia will endeavour to minimise the impact of any such changes on students and, where reasonably practicable, will provide advance notice of significant changes.

Nothing in this clause shall require La Xenia to continue offering any particular module, specialisation, elective, lecturer, campus, teaching method or service where this is no longer reasonably practicable or in the best interests of the Institution or its students.

Where changes are required to comply with legislation, accreditation standards, regulatory requirements, public health guidance or other mandatory obligations, such changes may take immediate effect without prior notice where reasonably necessary.

La Xenia shall not be liable for any indirect or consequential loss arising from reasonable changes made in accordance with this clause, except where such liability cannot be excluded under applicable law.

Accommodation

For students enrolled in programmes requiring residential study in Switzerland, designated student accommodation arranged or approved by La Xenia forms a compulsory part of the programme during all designated academic residence periods.

Students subject to this requirement must reside in the designated student accommodation allocated or approved by La Xenia throughout each applicable academic period. Students may not elect to reside with relatives, friends, partners, in privately arranged accommodation, hotels, rented apartments or any other alternative accommodation during these periods unless La Xenia has expressly authorised an exception in writing.

The compulsory residential accommodation requirement applies irrespective of whether a student has alternative accommodation available in Switzerland or could otherwise arrange accommodation independently.

La Xenia will allocate each student subject to the residential requirement a bed or place within a designated student residence, dormitory or other approved accommodation. Allocation of a particular building, room, room type or roommate is not guaranteed unless expressly confirmed in writing. La Xenia may change the assigned accommodation where reasonably necessary for operational, safety, capacity or other legitimate reasons.

Students must comply with all rules applicable to the designated student accommodation, including house rules, health and safety requirements, occupancy rules, quiet hours, guest policies, cleanliness requirements and reasonable instructions issued by La Xenia or the relevant accommodation provider.

Students must keep La Xenia informed of their current residential address throughout the duration of their studies and must promptly notify La Xenia of any authorised change of address or accommodation.

The compulsory residential accommodation requirement applies only during designated academic residence periods.

During an approved internship or work placement period, students are not permitted to reside in La Xenia-designated student accommodation. Students must instead reside in accommodation provided by the internship or work-placement provider, where available, or in other suitable accommodation arranged for the internship period.

Students are not charged the La Xenia Service Fee / Housing Package for any officially scheduled internship or work-placement period during which they are not entitled to occupy La Xenia-designated student accommodation.

Any accommodation, meals or other living costs arising during an internship or work-placement period are the responsibility of the student unless they are expressly provided by the internship or work-placement provider or otherwise confirmed in writing by La Xenia.

Outside officially scheduled internship, work-placement or other designated non-residential periods, students must reside in the student accommodation designated by La Xenia. An exception may be granted only where expressly approved in writing by La Xenia. The availability of alternative accommodation does not, by itself, create an exception to the compulsory residential accommodation requirement.

Students remain responsible for complying with all legal and administrative obligations connected with their residence, including registration requirements, occupancy regulations, immigration requirements and any obligations imposed by competent municipal, cantonal or federal authorities.

La Xenia accepts no responsibility for any unauthorised accommodation arrangement entered into independently by a student with a third party. Any such arrangement does not replace or cancel the student’s compulsory designated accommodation or financial obligations to La Xenia.

Failure to reside in the designated student accommodation during a compulsory academic residence period, unauthorised relocation to alternative accommodation, breach of applicable accommodation rules, failure to comply with immigration or residence requirements, or failure to provide accurate and up-to-date residential information to La Xenia may result in disciplinary action. Where required by law or regulatory obligation, La Xenia also reserves the right to notify the relevant authorities or take any action necessary to ensure compliance with applicable regulations.

Health and disability

Students should inform La Xenia of any medical condition, disability or other circumstance that may require reasonable adjustments or additional support during their studies.

This information enables La Xenia to assess whether appropriate support can be provided. Failure to disclose relevant information may limit the assistance that La Xenia is able to offer.

La Xenia is committed to supporting students with disabilities wherever reasonably practicable and encourages applicants to discuss any support requirements before commencing their studies.

Property damage

Students are responsible for any damage caused, whether intentionally or through negligence, to the property, facilities or equipment of La Xenia or its partners.

La Xenia reserves the right to recover the reasonable costs associated with repair or replacement.

Student Conduct

Students are expected to behave professionally and respectfully towards fellow students, staff and visitors at all times.

La Xenia reserves the right to suspend or permanently withdraw any student whose behaviour is considered unacceptable, disruptive or inconsistent with the Institution’s policies and regulations.

Where a student is withdrawn for disciplinary reasons, tuition fees will normally not be refunded.

Academic Participation (Online, Flexible and Blended Learning Students)

Students enrolled in online, flexible or blended learning programmes are not generally subject to minimum attendance requirements unless expressly stated within the programme regulations, module specifications or assessment requirements.

However, students remain responsible for actively participating in their programme and completing all required academic activities necessary for successful progression and graduation.

Students must complete all required assignments, assessments, examinations, projects, dissertations and any other academic requirements within the prescribed deadlines unless an approved extension has been granted in accordance with La Xenia policies.

Where live online sessions, tutorials, presentations, practical activities or other compulsory learning events form part of a programme or module, participation in such activities may be mandatory and students must comply with any attendance or participation requirements specified by La Xenia.

Failure to participate in required academic activities or failure to submit mandatory assessments may result in module failure, delayed progression, inability to graduate or other academic consequences in accordance with the applicable Academic Regulations.

Students are responsible for regularly accessing the Learning Management System (LMS), institutional email and other official communication channels to ensure they remain informed of academic requirements, assessment deadlines and programme updates. Failure to access these systems shall not constitute grounds for academic concession or exemption from programme requirements.

Attendance Requirements (On-Campus Students)

Students enrolled in on-campus programmes are required to attend all scheduled classes, lectures, tutorials, workshops, examinations and other compulsory academic activities in accordance with the applicable Attendance Policy published by La Xenia.

Attendance is an essential academic and immigration requirement. Students acknowledge that maintaining satisfactory attendance may be a condition of their continued enrolment, visa status and legal right to study in Switzerland.

Students are solely responsible for ensuring that they comply with all attendance requirements established by La Xenia, the relevant immigration authorities and any other competent regulatory bodies.

Failure to meet the minimum attendance requirements may result in academic penalties, the requirement to repeat modules, suspension of studies, disciplinary action or termination of enrolment in accordance with the applicable Academic Regulations and Attendance Policy.

Where required by Swiss law or regulatory obligations, La Xenia reserves the right to report prolonged or unexplained absences, changes in enrolment status or other relevant information to the appropriate cantonal, federal or immigration authorities.

Students who are unable to attend scheduled academic activities due to illness or other exceptional circumstances must notify La Xenia as soon as reasonably practicable and provide supporting documentation where requested. Submission of supporting documentation does not automatically excuse an absence or exempt the student from the applicable attendance requirements.

Students acknowledge that failure to satisfy attendance requirements may affect their academic progression, continued enrolment and immigration status. La Xenia accepts no responsibility for any consequences arising from a student’s failure to comply with attendance requirements or applicable immigration regulations,

Online Learning Requirements

Students enrolled in online, blended or flexible learning programmes are responsible for ensuring that they have the necessary technology, equipment and internet access required to participate fully in their programme of study.

Students are responsible for obtaining and maintaining, at their own expense, access to:

• a reliable broadband internet connection suitable for online learning activities;
• a computer, laptop or other compatible device capable of accessing the required learning platforms and software;
• a functioning webcam, microphone and speakers (or headset) where participation in live classes, assessments, presentations or meetings requires audio and video communication;
• supported web browsers, operating systems and any software specified by La Xenia as necessary for participation in the programme;
• a valid email account for official communications from La Xenia; and
• any additional hardware or software reasonably required to complete the programme.

Students are responsible for ensuring that their equipment remains operational and compatible with the technical requirements communicated by La Xenia. La Xenia may update its minimum technical requirements from time to time where necessary to support improvements to teaching, assessment or security.

Learning Management System (LMS)

Students are required to access and use the Learning Management System (LMS) and any other approved digital learning platforms provided by La Xenia throughout the duration of their studies.

Official course materials, learning resources, assessments, announcements, feedback and other academic communications may be delivered through the LMS. Students are responsible for regularly accessing the LMS and monitoring their institutional email account to ensure they remain informed of programme requirements, deadlines and communications.

Failure to access the LMS or review official communications does not exempt a student from complying with programme requirements, submission deadlines or other academic obligations.

Student Accounts and Login Credentials

Students are responsible for maintaining the confidentiality and security of their login credentials for all La Xenia systems, including the Learning Management System, institutional email accounts and any other digital platforms provided by La Xenia.

Login credentials must not be shared with any other individual. Students are responsible for all activity undertaken using their accounts unless they have promptly reported a suspected security breach to La Xenia.

Students must notify La Xenia immediately if they believe that their account has been compromised, accessed without authorisation or if they are unable to access their student accounts.

La Xenia reserves the right to suspend, restrict or reset access to student accounts where necessary to protect the security and integrity of its systems.

Technical Support and Connectivity

La Xenia will make reasonable efforts to ensure the availability of its online learning platforms. However, La Xenia cannot guarantee uninterrupted access to online services and shall not be liable for interruptions caused by circumstances beyond its reasonable control, including internet outages, software failures, third-party service disruptions or force majeure events.

Students are responsible for resolving issues relating to their own internet connection, personal devices, home network, software installations and other equipment required for participation in online learning.

Technical difficulties experienced by a student due to their own equipment, internet connection or failure to meet the published technical requirements will not normally constitute grounds for extensions, reassessments, refunds or other academic concessions unless otherwise determined by La Xenia in exceptional circumstances.

2. Study Modes

La Xenia offers a range of study modes designed to provide flexibility while maintaining consistent academic standards and learning outcomes. The study mode applicable to a student’s programme will be specified in the official programme information, Letter of Acceptance or other documentation issued by La Xenia.

Regardless of the mode of study, all students are required to successfully complete the prescribed learning outcomes, assessments and academic requirements in order to be eligible for progression and graduation.

La Xenia reserves the right to modify the delivery method of programmes or individual modules where reasonably necessary for academic, operational, regulatory, accreditation, quality assurance or other legitimate institutional reasons.

Self-Study (Asynchronous Learning)

Self-study programmes are delivered primarily through asynchronous learning, allowing students to study independently at times that best suit their individual circumstances.

Students are provided with access to learning materials, recorded lectures, reading resources, assessments and other academic content through the Learning Management System (LMS) or other approved platforms.

Students are responsible for managing their own study schedule and ensuring that all assignments, projects, assessments and other academic requirements are completed and submitted by the published deadlines.

Unless specifically stated within the module or programme, self-study programmes do not require attendance at scheduled live teaching sessions.

Failure to access learning materials or submit required assessments shall not constitute grounds for extensions, refunds or academic concessions unless otherwise approved by La Xenia.

Live Online (Synchronous Learning)

Live Online programmes are delivered through scheduled real-time online teaching sessions using platforms approved by La Xenia.

Students are expected to attend all compulsory live sessions where attendance forms part of the programme or module requirements.

Students may be required to actively participate during live sessions, including discussions, presentations, practical exercises, group work or assessments.

Where requested by the lecturer or required for assessment or academic integrity purposes, students must have access to a functioning webcam and microphone and may be required to keep their camera enabled during teaching sessions, examinations or presentations.

Failure to attend compulsory live sessions may result in academic penalties where attendance is a programme requirement.

Blended Learning

Blended Learning combines two or more methods of delivery, including face-to-face teaching, live online learning and self-directed study.

Students are required to participate in each component of the programme as specified within the programme structure.

Attendance requirements for face-to-face and live online components remain mandatory where specified by La Xenia, while self-study components remain subject to the applicable submission deadlines and assessment requirements.

Failure to participate in any compulsory component of a blended programme may affect academic progression, assessment outcomes or graduation eligibility.

Partner Centre Delivery

Certain La Xenia programmes may be delivered in cooperation with approved learning centres, academic partners or authorised delivery partners.

Students enrolled through a Partner Centre remain students of La Xenia and are subject to all applicable La Xenia Academic Regulations, Terms and Conditions, programme requirements and institutional policies.

In addition, students must comply with all reasonable academic, operational, administrative and behavioural requirements established by the Partner Centre, provided such requirements do not conflict with La Xenia policies or applicable law.

The Partner Centre may establish additional procedures relating to matters such as timetables, classroom attendance, use of facilities, local student services, administrative processes, examinations or other operational matters.

Failure to comply with the reasonable policies or procedures of an approved Partner Centre may result in disciplinary action by the Partner Centre, La Xenia or both, where appropriate.

Where there is any conflict between the academic regulations of La Xenia and the local operational procedures of the Partner Centre, the academic regulations and policies of La Xenia shall prevail unless otherwise required by law.

Attendance and Participation Requirements

Attendance and participation requirements vary depending upon the study mode and the specific programme or module.

• On-campus programmes are subject to the Attendance Policy published by La Xenia and, where applicable, Swiss immigration requirements.
• Self-study programmes generally do not require attendance at scheduled teaching sessions but require timely completion of all prescribed academic work.
• Live Online programmes may require attendance at scheduled online teaching sessions, together with active participation where specified.
• Blended Learning programmes require students to comply with the attendance and participation requirements applicable to each delivery component.
• Partner Centre programmes may include additional attendance or participation requirements established by the approved Partner Centre, provided such requirements are consistent with La Xenia policies.

Students are responsible for familiarising themselves with the attendance and participation requirements applicable to their programme and study mode.

Changes to Study Mode

La Xenia reserves the right to approve or refuse requests to change a student’s study mode.

Approval of any change remains entirely at the discretion of La Xenia and may be subject to academic, operational, regulatory, immigration, accreditation, visa or programme-specific requirements.

A change of study mode may result in changes to tuition fees, programme duration, assessment methods, attendance requirements or graduation requirements. Students remain responsible for complying with all requirements applicable to their approved study mode.

Academic Integrity

La Xenia is committed to maintaining the highest standards of academic integrity, honesty and ethical conduct. Students are expected to complete all academic work honestly, independently where required, and in accordance with the academic standards of the Institution.

Academic integrity applies to all forms of assessment, including written assignments, examinations, presentations, projects, dissertations, research activities, practical assessments and any other work submitted for academic credit.

Students are responsible for ensuring that all work submitted for assessment represents their own knowledge, understanding and academic effort, except where collaboration has been expressly authorised.

Academic Misconduct

Academic misconduct includes, but is not limited to:

• plagiarism;
• self-plagiarism or the resubmission of previously assessed work without permission;
• collusion;
• contract cheating;
• unauthorised collaboration;
• impersonation or arranging for another person to complete academic work or assessments;
• fabrication or falsification of research data, references, citations or academic records;
• examination misconduct;
• unauthorised use of notes, electronic devices or prohibited materials during assessments;
• obtaining or attempting to obtain examination materials without authorisation;
• assisting another student to commit academic misconduct;
• misuse of Artificial Intelligence (AI) or other digital tools in breach of La Xenia policies; and
• any other attempt to obtain an unfair academic advantage.

La Xenia reserves the right to determine whether any conduct constitutes academic misconduct.

Plagiarism

Students must properly acknowledge and reference all sources used in their academic work in accordance with the referencing style prescribed by La Xenia.

Plagiarism includes presenting another person’s words, ideas, research, data, images, designs or other intellectual property as one’s own without appropriate acknowledgement.

Plagiarism may occur regardless of whether the source is obtained from books, journals, websites, artificial intelligence systems, other students or any other source.

Collusion and Unauthorised Collaboration

Students must not collaborate with another individual on assessed work unless such collaboration has been expressly authorised as part of the assessment requirements.

Students must not knowingly permit another individual to copy, reproduce or submit their work as that individual’s own.

Contract Cheating

Students must not obtain, purchase, commission or otherwise procure academic work from another individual or organisation for submission as their own.

Similarly, students must not complete academic work for another student or knowingly assist another individual in committing contract cheating.

The use of essay-writing services, assignment mills or similar services is strictly prohibited.

Artificial Intelligence (AI)

La Xenia recognises that Artificial Intelligence (AI) technologies may support learning when used responsibly and ethically.

Students may use AI tools only to the extent permitted by the relevant assessment instructions, programme regulations and La Xenia Academic Integrity Policy.

Where AI has been used in preparing academic work, students must accurately disclose such use where required by La Xenia and remain fully responsible for the accuracy, originality, integrity and academic quality of all submitted work.

Students must not use AI or any automated technology to generate assessments, research, dissertations, projects or other academic work where such use has been prohibited or exceeds the permitted level of assistance.

Failure to disclose AI use where required, or presenting AI-generated content as original independent work, may constitute academic misconduct.

La Xenia reserves the right to amend its policies regarding AI usage as technologies and educational practices evolve. Students are responsible for complying with the version of the Academic Integrity Policy in force at the time of assessment.

Oral Defences and Verification of Authorship

La Xenia reserves the right to require any student to participate in an oral defence, viva voce examination, interview, presentation or other verification process to demonstrate authorship, understanding and ownership of submitted academic work.

Students may also be required to submit research notes, draft versions, working papers, raw data, research diaries or other supporting evidence demonstrating the development of their work.

Failure to satisfactorily demonstrate authorship or academic understanding may result in the work being investigated under the Academic Integrity procedures.

Academic Integrity Investigations

La Xenia reserves the right to investigate any suspected breach of academic integrity.

Such investigations may include, but are not limited to:

• plagiarism detection software;
• AI detection tools or other technological methods;
• oral examinations or interviews;
• review of drafts and research records;
• comparison with previous submissions;
• review by internal or external academic experts; and
• any other reasonable verification process considered appropriate by La Xenia.

Students are expected to cooperate fully with any academic integrity investigation.

Academic Penalties

Where academic misconduct is established, La Xenia may impose one or more of the following sanctions:

• formal warning;
• requirement to resubmit work;
• reduction or removal of marks;
• failure of the assessment or module;
• requirement to repeat a module;
• suspension from the programme;
• termination of enrolment;
• withholding of academic results, transcripts or awards;
• revocation of an academic award where permitted by law; or
• any other academic or disciplinary sanction considered appropriate by La Xenia.

The sanction imposed shall reflect the nature, seriousness and circumstances of the misconduct.

Professional and Ethical Conduct

Students are expected to uphold the principles of honesty, fairness, responsibility, respect and integrity throughout their studies.

Academic misconduct undermines the value of qualifications awarded by La Xenia and may affect a student’s academic standing, future professional opportunities and eligibility to graduate.

Students are expected to familiarise themselves with and comply with all Academic Integrity policies, assessment regulations and guidance issued by La Xenia from time to time.

Assessment Regulations

Students are responsible for complying with all assessment regulations, academic requirements and programme-specific policies applicable to their programme of study.

Assessment requirements, including but not limited to assessment methods, grading criteria, passing requirements, progression requirements, submission deadlines, examination procedures, reassessment opportunities, resubmission requirements, oral examinations, dissertations, projects and practical assessments, are published within the relevant programme documentation, module specifications, student handbooks, academic regulations or other official documentation issued by La Xenia.

Students acknowledge that these programme-specific regulations form part of the academic requirements of their programme and agree to comply with them throughout their studies.

Submission of Assessments

Students are responsible for submitting all required assessments by the published deadlines and in accordance with the instructions issued by La Xenia.

Failure to submit assessments by the prescribed deadline may result in academic penalties, including but not limited to reduced marks, assessment failure, module failure or other consequences as specified within the applicable programme regulations.

Failure to submit an assessment does not relieve a student of any financial obligations owed to La Xenia.

Extensions and Mitigating Circumstances

Students who are unable to complete an assessment or attend an examination due to exceptional circumstances should notify La Xenia as soon as reasonably practicable and submit any required supporting evidence in accordance with the applicable programme regulations.

Requests for extensions, deferred assessments or other academic concessions will be considered in accordance with the relevant academic policies and procedures. Approval is not automatic and remains at the discretion of La Xenia or the relevant Academic Committee.

Reassessment and Resubmission

Where permitted under the applicable programme regulations, students may be offered an opportunity to undertake a reassessment, resubmit an assessment or repeat a module.

Any reassessment, resubmission or module retake shall be subject to the applicable Academic Regulations, programme-specific requirements and any additional conditions determined by La Xenia.

A reassessment fee or resubmission fee may be charged for any reassessment or resubmission opportunity. The applicable fee shall be determined by La Xenia and published in the relevant fee schedule or programme information.

Where a student fails a module and is required to repeat the module, the student shall be responsible for paying the applicable module retake fee or tuition fee in accordance with the La Xenia Tuition Fee Schedule in force at the time of re-enrolment.

Payment of all applicable reassessment, resubmission or module retake fees must be received before the reassessment, resubmission or repeat module may be undertaken, unless otherwise agreed in writing by La Xenia.

La Xenia does not guarantee that reassessment, resubmission or module retake opportunities will be available for every assessment, module or programme. Such opportunities remain subject to the applicable Academic Regulations, accreditation requirements and programme-specific rules.

Learning Platform

La Xenia provides students with access to various digital learning platforms, Learning Management Systems (LMS), institutional email accounts, video conferencing systems, online assessment platforms, digital libraries and other electronic resources to support teaching, learning and academic administration.

Students are responsible for accessing and using these systems in accordance with the instructions, policies and procedures issued by La Xenia from time to time.

Access to Digital Services

Students are responsible for ensuring that they maintain regular access to the digital platforms required for their programme of study and for regularly checking the Learning Management System (LMS), institutional email account and other official communication channels for announcements, academic information, assessment deadlines and programme updates.

Failure to access digital platforms or review official communications shall not constitute grounds for academic concession, deadline extensions or exemption from programme requirements.

Changes to Learning Platforms

La Xenia reserves the right to introduce, replace, discontinue or modify any Learning Management System (LMS), digital platform, software application, communication platform or other technology used in the delivery or administration of its programmes where considered necessary for academic, operational, security, quality assurance, regulatory or other legitimate institutional reasons.

Students agree to use any replacement or updated platform designated by La Xenia and acknowledge that reasonable changes to digital systems shall not constitute grounds for withdrawal, refund or other compensation.

La Xenia will endeavour to provide reasonable notice of significant platform changes where practicable and will provide appropriate guidance to support students during any transition.

System Availability and Maintenance

Whilst La Xenia will make reasonable efforts to ensure the availability and reliability of its digital services, uninterrupted access cannot be guaranteed.

Students acknowledge that temporary interruptions, scheduled maintenance, software updates, security improvements, system upgrades, technical faults, cyber security incidents or failures of third-party service providers may result in temporary unavailability of digital platforms.

La Xenia shall not be liable for any loss, inconvenience or delay arising from temporary interruptions to digital services where such interruptions are reasonably necessary or beyond the reasonable control of La Xenia.

Where reasonably practicable, planned maintenance or significant service interruptions will be communicated to students in advance.

Intellectual Property and Digital Resources

All learning materials, recorded lectures, presentations, videos, assessment materials, examinations, module content, teaching resources, software, templates, documents and other digital resources made available by La Xenia remain the intellectual property of La Xenia or the relevant copyright holder unless expressly stated otherwise.

Students are granted a limited, non-exclusive, non-transferable licence to access and use these materials solely for their personal educational purposes during their period of enrolment.

Students must not copy, reproduce, distribute, publish, upload, record, sell, licence, modify, share or otherwise make La Xenia learning materials or digital resources available to any third party without the prior written consent of La Xenia, except where expressly permitted by applicable copyright legislation.

Unauthorised use, reproduction or distribution of La Xenia learning materials may result in disciplinary action, termination of access to digital services, legal action or any other remedies available to La Xenia under applicable law.

Student Accounts and Access

Access to La Xenia digital platforms is provided solely for the student’s personal educational use.

Students are responsible for maintaining the confidentiality of their login credentials and must not permit any other individual to access La Xenia systems using their account.

La Xenia reserves the right to suspend, restrict or terminate access to digital platforms where necessary to protect the security, integrity or proper operation of its systems, where a student breaches these Terms and Conditions, or where a student’s enrolment has ended.

Following graduation, withdrawal, suspension or termination of enrolment, La Xenia reserves the right to deactivate student accounts and remove access to digital platforms, institutional email accounts and learning resources in accordance with its data retention and information security policies.

Recording of Classes

Where a programme or module includes live online teaching, tutorials, seminars, presentations or other synchronous learning activities, La Xenia may record such sessions for academic, quality assurance, training, accessibility or administrative purposes.

By participating in live online teaching, students acknowledge and consent to the recording of such sessions where recording has been authorised by La Xenia.

All recordings, including but not limited to video, audio, presentations, chat messages, teaching materials and any other content captured during live online sessions, shall remain the sole and exclusive property of La Xenia.

La Xenia reserves the right to make recorded teaching sessions available to students through the Learning Management System (LMS) or other approved digital platforms for educational purposes. Such recordings may also be retained and made available to future cohorts of students where considered appropriate by La Xenia.

Access to recorded teaching sessions shall be determined solely by La Xenia. Recordings may be made available to current students, future students, academic staff or other authorised persons where necessary for teaching, quality assurance or academic administration.

Students are granted a limited, non-exclusive, non-transferable licence to access recorded teaching sessions solely for their own personal educational purposes. Students shall not copy, download, distribute, publish, edit, reproduce, upload, share or otherwise make recordings available to any third party without the prior written consent of La Xenia.

Students are strictly prohibited from making their own audio recordings, video recordings, screen recordings, screenshots or other reproductions of live online teaching sessions, whether in whole or in part, unless prior written permission has been granted by La Xenia or such recording is required as a reasonable accommodation approved by La Xenia.

Unauthorised recording, reproduction or distribution of live teaching sessions or recorded content may constitute a breach of these Terms and Conditions, the Academic Integrity Policy, applicable copyright legislation or data protection laws and may result in disciplinary action, suspension or termination of enrolment, legal proceedings or any other remedies available to La Xenia.

La Xenia will process recordings containing personal data in accordance with its Privacy Policy and applicable data protection legislation.

Students who do not wish to appear on camera during recorded teaching sessions should notify La Xenia in advance. Where participation in a recorded session forms part of an assessment, oral defence or other compulsory academic activity, students may nevertheless be required to appear on camera where this is necessary to verify identity, assess participation or maintain academic integrity.

Intellectual Property

All teaching materials, academic resources and educational content provided by La Xenia, whether in printed, digital, audio or video format, remain the intellectual property of La Xenia or the relevant copyright holder unless expressly stated otherwise.

This includes, but is not limited to:

• module handbooks;
• programme handbooks;
• lecture slides and presentations;
• teaching notes;
• recorded lectures and live online teaching sessions;
• videos and multimedia resources;
• assessments, examination papers and assessment materials;
• case studies, exercises and learning activities;
• learning guides and reading materials;
• templates, forms and academic documentation;
• Learning Management System (LMS) content; and
• any other educational materials developed, commissioned or licensed by La Xenia.

Students are granted a limited, non-exclusive, non-transferable and revocable licence to access and use such materials solely for their own personal educational purposes during their period of enrolment.

Students shall not, without the prior written permission of La Xenia:

• copy, reproduce or modify La Xenia materials except where reasonably necessary for their personal studies;
• distribute, publish, upload or otherwise make materials available to any third party;
• share teaching materials through websites, cloud storage services, social media platforms, messaging applications or artificial intelligence systems;
• sell, licence or commercially exploit any La Xenia educational materials;
• create derivative works based upon La Xenia teaching materials for commercial or educational distribution;
• remove, alter or obscure any copyright notices, trademarks or other proprietary notices contained within La Xenia materials.

Students shall not provide their access credentials or permit any third party to access La Xenia learning materials using their student accounts.

The intellectual property rights in all educational materials shall remain with La Xenia or the relevant rights holder both during and after a student’s enrolment. Termination of enrolment, graduation or withdrawal does not grant the student any continuing rights to reproduce, distribute or otherwise use La Xenia intellectual property beyond those expressly permitted by law.

Nothing within these Terms and Conditions transfers ownership of any intellectual property rights from La Xenia or any third-party rights holder to the student.

La Xenia reserves the right to take disciplinary, contractual or legal action against any person who infringes its intellectual property rights or the intellectual property rights of its staff, partners or licensors.

Use of La Xenia Materials with Artificial Intelligence

Students shall not upload, submit or otherwise provide La Xenia teaching materials, examination papers, assessment briefs, recorded lectures or other proprietary educational content to publicly accessible artificial intelligence platforms or similar technologies where such use may result in the reproduction, storage, training or redistribution of La Xenia intellectual property, unless expressly authorised in writing by La Xenia.

Students remain responsible for ensuring that any use of artificial intelligence technologies complies with these Terms and Conditions, the Academic Integrity Policy and any programme-specific guidance issued by La Xenia.

Activation of Student Accounts 

Upon enrolment, students may be provided with access to one or more official La Xenia systems, including but not limited to institutional email accounts, the Learning Management System (LMS), OpenSIS, online library services, video conferencing platforms and other digital resources used for academic or administrative purposes.

Students are responsible for activating, maintaining and regularly accessing all official La Xenia systems throughout their period of enrolment.

Official Communication

La Xenia communicates with students primarily through its official communication channels, including but not limited to:

• institutional email accounts;
• OpenSIS;
• the Learning Management System (LMS);
• official student portals;
• other digital platforms designated by La Xenia.

Students are responsible for checking these systems regularly to ensure they remain informed of programme updates, academic requirements, assessment deadlines, examination information, fee notices, disciplinary matters and all other official communications.

Communications issued through La Xenia’s official communication channels shall be deemed to have been received by the student, regardless of whether the student has accessed, opened or read the communication.

Failure to monitor official communication channels shall not constitute grounds for academic concession, extension of deadlines, refund requests or exemption from any academic, financial or administrative obligation.

Student Accounts

Student accounts are issued solely for the student’s personal academic and administrative use.

Students must not:

• share their usernames or passwords with any other individual;
• permit another person to access La Xenia systems using their credentials;
• attempt to gain unauthorised access to another user’s account or any La Xenia system;
• interfere with the security or operation of La Xenia information systems.

Students are responsible for maintaining the confidentiality and security of their login credentials and are responsible for all activity carried out using their accounts unless a suspected security breach has been promptly reported to La Xenia.

Students must immediately notify La Xenia if they become aware of any unauthorised access to their accounts, suspected compromise of their credentials or any other information security incident affecting their student accounts.

Availability and Use of Student Accounts

La Xenia reserves the right to suspend, restrict, modify or terminate access to student accounts where necessary for academic, operational, disciplinary, security, regulatory or legal reasons.

Student access to institutional systems, including but not limited to institutional email accounts, OpenSIS, the Learning Management System (LMS) and other digital services, may be withdrawn following graduation, withdrawal, suspension, termination of enrolment or any other cessation of student status.

Students are responsible for downloading or retaining any personal academic records or materials made available through La Xenia systems before access is withdrawn, except where La Xenia is required by law or institutional policy to retain or provide continued access to such information.

Data Accuracy

Students are responsible for ensuring that their personal information, including their residential address, email address, telephone number and emergency contact details, remains accurate and up to date throughout their enrolment.

Students must notify La Xenia promptly of any changes to their contact details. La Xenia shall not be responsible for any consequences arising from a student’s failure to maintain accurate and up-to-date contact information.

Data Protection

La Xenia is committed to protecting the privacy and personal data of its students and processes personal information in accordance with applicable data protection legislation, including the Swiss Federal Act on Data Protection (FADP), the General Data Protection Regulation (GDPR), where applicable, and any other relevant legislation.

By applying for admission, enrolling in a programme or otherwise engaging with La Xenia, students acknowledge that La Xenia will collect, use, store and process personal information for legitimate educational, administrative, regulatory and legal purposes.

The collection and processing of personal data are further governed by the La Xenia Privacy Policy, as amended from time to time, which forms part of the information provided to students.

Processing of Personal Data

La Xenia may collect and process personal data, including but not limited to:

• personal identification and contact details;
• passport, visa and immigration information;
• academic records and assessment results;
• attendance records and engagement with academic activities;
• financial and payment information;
• disciplinary records;
• communications with students;
• information relating to student support services;
• technical information generated through the use of La Xenia digital platforms; and
• any other information reasonably required for the administration and delivery of educational services.

Such information may be processed for purposes including, but not limited to:

• processing applications and enrolment;
• delivering academic programmes;
• conducting assessments and awarding qualifications;
• maintaining academic and administrative records;
• providing student support services;
• complying with accreditation, quality assurance and regulatory requirements;
• complying with immigration, taxation and other legal obligations;
• protecting the security and integrity of La Xenia systems; and
• any other legitimate educational or administrative purpose.

Disclosure of Information

La Xenia may disclose student information where necessary to:

• government authorities;
• immigration authorities;
• accreditation or quality assurance bodies;
• awarding organisations;
• academic partners;
• approved learning centres;
• examination providers;
• external service providers acting on behalf of La Xenia; or
• any other organisation where disclosure is required by law or reasonably necessary for the administration of a student’s programme.

La Xenia will only disclose personal information where there is an appropriate legal basis for doing so.

Online Learning Systems

Students acknowledge that participation in online learning requires the use of digital systems operated by La Xenia or approved third-party providers.

The use of Learning Management Systems (LMS), OpenSIS, institutional email accounts, video conferencing platforms, online assessment systems and other digital services may involve the collection and processing of personal data necessary for the delivery, administration, security and quality assurance of academic programmes.

Students acknowledge that La Xenia may process information relating to their use of these systems, including login activity, attendance, assessment submissions, communications and other information reasonably required for academic administration and information security.

Recorded Teaching Sessions

Where live online teaching sessions are recorded, La Xenia may process personal data contained within those recordings for educational, academic administration, quality assurance, accessibility and regulatory purposes in accordance with these Terms and Conditions and the La Xenia Privacy Policy.

Privacy Policy

Further information regarding the collection, processing, storage, retention, sharing and protection of personal data, together with students’ rights under applicable data protection legislation, is set out in the La Xenia Privacy Policy.

Students are responsible for familiarising themselves with the Privacy Policy and any amendments published by La Xenia from time to time.

Online Examinations

Where examinations, assessments, oral examinations, presentations or other academic activities are conducted online, students must comply with all instructions, procedures and technical requirements issued by La Xenia for the relevant assessment.

Students are responsible for ensuring that they have a suitable environment, appropriate equipment and a stable internet connection for the duration of any online assessment.

Identity Verification

La Xenia reserves the right to verify a student’s identity before, during or after any online assessment using any reasonable method considered appropriate by the Institution.

Identity verification may include, but is not limited to:

• presentation of official photographic identification;
• live video verification;
• oral questioning or viva voce examinations;
• verification through institutional accounts or approved authentication systems; or
• any other identity verification procedure reasonably required by La Xenia.

Failure to satisfactorily verify identity may result in the assessment being suspended, declared invalid or investigated under the Academic Integrity Policy.

Assessment Conditions

Students must follow all examination instructions and assessment conditions published by La Xenia or communicated by the examiner.

Where required, students may be instructed to:

• participate with a functioning webcam and microphone;
• position their camera to provide an appropriate view of their examination environment;
• ensure that they are alone in the assessment environment unless otherwise authorised;
• refrain from accessing unauthorised materials, devices or applications during the assessment; and
• comply with any additional procedures reasonably required to preserve academic integrity.

Failure to comply with examination conditions may constitute academic misconduct.

Remote Invigilation and Proctoring

Where considered necessary to maintain academic standards or comply with accreditation or regulatory requirements, La Xenia reserves the right to use remote invigilation, online proctoring or other examination monitoring methods during online assessments.

Students are required to comply with any reasonable invigilation procedures implemented by La Xenia. Details of any proctoring requirements will be communicated in advance where reasonably practicable.

Technical Difficulties

Students are responsible for ensuring that their equipment, internet connection and software are suitable for the assessment before it begins.

Where technical difficulties occur during an online assessment, students must notify La Xenia immediately using the procedure communicated for that assessment.

La Xenia will consider genuine technical issues on a case-by-case basis. However, technical difficulties arising from the student’s own equipment, internet connection, software, failure to meet published technical requirements or failure to prepare appropriately shall not automatically entitle the student to additional time, reassessment, extension, academic concession or other remedy.

Where a widespread technical failure affecting La Xenia systems or an approved examination platform materially disrupts an assessment, La Xenia reserves the right to suspend, reschedule, repeat or otherwise modify the assessment in a manner it considers appropriate.

Dissertation / Final Projects

Certain programmes offered by La Xenia require the successful completion of a dissertation, final project, capstone project, business project or other substantial independent academic work as a requirement for graduation.

Students are responsible for complying with all dissertation or project regulations applicable to their programme, including submission requirements, formatting guidelines, assessment criteria and deadlines. Detailed requirements will be published within the relevant programme documentation and/or the Learning Management System (LMS).

Supervision

Where academic supervision is available, the level of supervision provided shall be determined by the applicable programme regulations.

Unless expressly stated otherwise in the official programme information or tuition fee schedule, dissertation or project supervision is not included within the published tuition fees and may be subject to additional charges.

Ownership and Use of Academic Work

Students retain ownership of the intellectual property rights in their original dissertation, project or other assessed work, except where otherwise agreed in writing or where third-party intellectual property rights apply.

By submitting academic work for assessment, students grant La Xenia a non-exclusive, worldwide, royalty-free licence to retain, reproduce, store, process and use the submitted work for academic administration, assessment, moderation, quality assurance, accreditation, examination, plagiarism detection, academic integrity investigations and internal educational purposes.

La Xenia shall not publish or commercially exploit a student’s dissertation or final project without the student’s consent, except where required by law or necessary for academic administration, accreditation or quality assurance purposes.

Minimum Technology Requirements

Students are responsible for ensuring that they have access to suitable technology throughout their period of study. The requirements set out below represent the minimum technical specifications necessary to access La Xenia online services and participate in online learning. La Xenia reserves the right to amend these requirements where necessary to reflect changes in technology, software or programme delivery. Updated requirements will be communicated through official La Xenia communication channels.

Office Software	Software capable of creating, editing and viewing Microsoft Word, Excel and PowerPoint files (e.g. Microsoft Office or equivalent compatible software).
PDF Reader	Software capable of viewing PDF documents.
Audio & Video	Working webcam, microphone and speakers/headset for live online classes, oral assessments and student meetings where required.
Email	Access to the student’s official La Xenia email account and the ability to send and receive emails.
Learning Platforms	Access to OpenSIS, the Learning Management System (LMS) and any other digital platforms designated by La Xenia.
Hardware	A desktop or laptop computer capable of supporting the software and platforms required for the student’s programme.

Students are responsible for maintaining their equipment in good working order, installing required software updates and ensuring compatibility with La Xenia systems. Failure to meet the minimum technology requirements shall not ordinarily constitute grounds for academic concession, deadline extensions or refund requests.

Specialisations

Many La Xenia programmes offer students the opportunity to complete one or more academic specialisations. The specialisations available for each programme are determined by La Xenia and are intended to reflect current academic developments, industry needs and institutional resources.

The current list of available specialisations is published on the La Xenia website and may be updated from time to time. Students acknowledge that the availability of any particular specialisation is not guaranteed and may change before or during their programme of study.

Selection of Specialisations

Where a programme includes one or more specialisations, students shall be invited to select their preferred specialisation(s) in accordance with the procedures and deadlines determined by La Xenia.

Submission of a preference does not constitute a guarantee that the selected specialisation will be offered or that the student will be enrolled in that specialisation.

Availability of Specialisations

La Xenia reserves the right, at its sole discretion, to:

• introduce new specialisations;
• discontinue existing specialisations;
• amend the curriculum or title of a specialisation;
• postpone the commencement of a specialisation;
• combine or separate specialisation groups;
• substitute modules within a specialisation where academically appropriate; or
• make any other changes reasonably necessary for academic, operational, regulatory or quality assurance purposes.

Not all advertised specialisations will necessarily be available in every intake, study mode, campus or academic year.

Minimum Enrolment Requirements

Unless otherwise specified by La Xenia, a minimum enrolment of ten (10) students is required for a specialisation to proceed.

La Xenia reserves the right to cancel, postpone or combine a specialisation where the minimum enrolment requirement is not met, even where a student has received confirmation of enrolment into that specialisation.

In exceptional circumstances, La Xenia may, at its sole discretion, elect to offer a specialisation with fewer than the stated minimum number of students. Such a decision shall not create any expectation or precedent for future intakes.

Alternative Specialisations

Where a selected specialisation is unavailable, cancelled or postponed, La Xenia may require students to select an alternative specialisation from those available for the relevant programme.

La Xenia will use reasonable efforts to accommodate student preferences; however, the final allocation of students to specialisations shall remain at the discretion of La Xenia, having regard to academic quality, staffing, regulatory requirements, operational considerations and available resources.

The cancellation or substitution of a specialisation shall not, of itself, constitute grounds for withdrawal, compensation or refund, except where required by applicable law.

La Xenia does not guarantee that every specialisation advertised at the time of application or enrolment will remain available throughout the duration of a student’s programme. 

Intakes

The commencement dates, intake periods and programme schedules for all La Xenia programmes are determined by La Xenia and may vary between programmes, campuses and study modes.

Students are responsible for commencing their studies on the intake confirmed by La Xenia and must coordinate their arrival, registration and induction with the Institution where applicable.

Students enrolled on on-campus programmes must not travel to or arrive in Switzerland before the date authorised by La Xenia. Students who arrive before their approved commencement date or otherwise fail to comply with La Xenia arrival instructions may be subject to disciplinary action and may also experience immigration or accommodation difficulties for which La Xenia accepts no responsibility.

On-campus programmes are normally offered with one or more scheduled intakes each academic year. Flexi-Learn programmes normally operate on rolling monthly intakes. However, La Xenia reserves the right to amend intake schedules, commencement dates and programme availability at its discretion.

Detailed information regarding module scheduling, study plans, timetables and programme progression will be communicated by La Xenia through the relevant programme documentation and/or the Learning Management System (LMS) and may be amended from time to time.

Recognition

La Xenia programmes are delivered in accordance with the approvals, accreditations and authorisations applicable to the Institution and the relevant programme at the time of delivery. Information regarding institutional approvals, programme approvals, accreditations and memberships is published by La Xenia and may be amended from time to time.

While La Xenia endeavours to provide accurate information regarding its programmes and qualifications, La Xenia makes no representation or warranty that any qualification awarded by the Institution will be recognised for any particular purpose by any government, employer, professional body, licensing authority, educational institution or other third party.

In particular, La Xenia does not guarantee that completion of a programme will:

• lead to employment or promotion;
• satisfy the requirements for professional registration, licensing or certification;
• permit admission to another educational institution or programme;
• be recognised by any government authority, employer, professional body or educational institution in any jurisdiction;
• satisfy immigration or visa requirements; or
• qualify a student for any particular occupation, profession or regulated activity.

Recognition of qualifications, admission to further study, professional registration, employment opportunities and immigration decisions are determined solely by the relevant third parties in accordance with their own requirements, policies and applicable legislation, which may change at any time.

Students are solely responsible for determining whether an La Xenia qualification meets the requirements of any employer, professional body, licensing authority, educational institution, government authority or other organisation relevant to their intended career or further studies before enrolling in a programme.

La Xenia shall not be liable for any loss, expense, delay or other consequence arising from a decision by any third party not to recognise, accept or otherwise give effect to a qualification awarded by La Xenia.

Students acknowledge that changes to the Institution’s approvals, accreditations, memberships or recognitions do not automatically affect the validity of studies already undertaken or qualifications awarded, unless determined by the relevant regulatory or accrediting authority.

Accreditation

La Xenia continuously seeks to maintain and enhance its institutional approvals, programme approvals, accreditations, memberships, recognitions and quality assurance arrangements. However, students acknowledge that such approvals and recognitions are granted, renewed, suspended, amended, withdrawn or otherwise determined by independent third-party organisations and regulatory authorities over which La Xenia has no direct control.

Accordingly, La Xenia does not guarantee that any particular approval, accreditation, membership, recognition, ranking or quality assurance status held by the Institution or any of its programmes at the time of application, enrolment or commencement of studies will remain unchanged throughout a student’s period of study.

La Xenia reserves the right to obtain, renew, replace, amend, discontinue or otherwise modify any institutional or programme approval, accreditation, membership or recognition where considered necessary or appropriate for academic, regulatory, operational or strategic reasons, or as a consequence of decisions made by external organisations.

Where an approval, accreditation or recognition changes during a student’s period of study, La Xenia will take reasonable steps to minimise any adverse academic impact and, where appropriate, communicate relevant information to affected students. However, such changes shall not, in themselves, constitute a breach of contract or entitle a student to withdraw, claim compensation, seek damages, request fee reductions or obtain a refund, except where required by applicable law.

Students acknowledge that external organisations, employers, governments, professional bodies and educational institutions may alter their own recognition policies independently of La Xenia, and that La Xenia accepts no responsibility for decisions made by such third parties regarding the recognition or acceptance of its qualifications.

Suspension, Disciplinary Action and Expulsion

Students are expected to comply with these Terms and Conditions, all applicable La Xenia policies, programme regulations and any lawful instructions issued by the Institution.

Where a student fails to meet their academic, financial or behavioural obligations, La Xenia may take disciplinary or administrative action in accordance with the applicable policies and procedures.

Subject to the seriousness of the matter, disciplinary action may include, but is not limited to:

• verbal or written warnings;
• academic or administrative conditions;
• temporary suspension from classes, assessments or other La Xenia activities;
• restriction of access to La Xenia facilities or digital systems;
• permanent expulsion or termination of enrolment.

Nothing in these Terms and Conditions requires La Xenia to apply disciplinary measures sequentially. Where the nature or seriousness of the conduct warrants it, La Xenia may impose immediate suspension, expulsion or any other appropriate sanction without first issuing a warning.

During any period of suspension, students may be prohibited from attending classes, participating in assessments, accessing La Xenia facilities or using institutional systems, as determined by La Xenia.

Detailed disciplinary procedures, grounds for suspension or expulsion, appeal rights and any programme-specific requirements are set out in the relevant La Xenia policies applicable to the student’s programme. Students are responsible for familiarising themselves with those policies and complying with them throughout their studies. 

Nothing in these Terms and Conditions requires La Xenia to apply disciplinary measures sequentially. 

Appeals

Students have the right to appeal certain academic or disciplinary decisions in accordance with the applicable La Xenia policies and procedures.

Academic appeals and disciplinary appeals are governed by separate procedures and must be submitted in the manner and within the timeframes specified in the relevant La Xenia policy.

The availability of an appeal does not automatically suspend or delay the implementation of the original decision unless La Xenia expressly determines otherwise.

Students should refer to the applicable La Xenia Appeals and Complaints Policy and any programme-specific regulations for detailed information regarding eligibility, procedures and applicable deadlines.

Governing Law

These Terms and Conditions, the student’s enrolment, and the entire legal relationship between the student and La Xenia shall be governed exclusively by the substantive laws of Switzerland, excluding its conflict of laws rules.

To the fullest extent permitted by applicable law, the courts having jurisdiction over the registered office of La Xenia at the time the dispute arises shall have exclusive jurisdiction to hear and determine any dispute, claim or proceeding arising out of or in connection with:

• these Terms and Conditions;
• an application for admission or enrolment;
• tuition fees, refunds or other payments;
• the delivery, suspension or termination of studies;
• academic, disciplinary or administrative decisions;
• any qualification, certificate or academic record; or
• any other aspect of the relationship between the student and La Xenia.

The student irrevocably agrees that any such dispute, claim or proceeding shall be commenced and pursued exclusively before the competent courts of Switzerland having jurisdiction over the registered office of La Xenia at the time the dispute arises, and not before the courts or authorities of the student’s country of nationality, residence, domicile or any other jurisdiction.

The student irrevocably waives, to the fullest extent permitted by applicable law, any objection to the jurisdiction or venue of such courts, including any objection based on residence, nationality, domicile, inconvenience, distance, cost or the assertion that another forum would be more appropriate.

La Xenia does not submit to the jurisdiction of any foreign court merely because a student resides, studies, accesses online services, makes payments or receives communications outside Switzerland.

Nothing in this section shall prevent La Xenia from commencing proceedings or seeking interim, protective, enforcement or debt recovery measures in any jurisdiction where the student or the student’s assets are located. Any such action shall not constitute a waiver of the exclusive jurisdiction of the competent Swiss courts.

Nothing in this section shall affect any rights or jurisdiction that cannot lawfully be excluded under mandatory applicable law.

Changes to Regulations

La Xenia reserves the right to amend, replace, withdraw or introduce academic regulations, policies, procedures, programme requirements and other institutional rules at any time where reasonably necessary.

Such changes may be made for reasons including, but not limited to:

• compliance with applicable laws, regulations or regulatory requirements;
• requirements or recommendations of accrediting bodies, awarding organisations or quality assurance agencies;
• academic quality assurance and enhancement;
• operational, administrative or technological developments;
• protection of the interests, safety or wellbeing of students, staff or the Institution; or
• any other legitimate institutional reason.

Where appropriate, La Xenia will notify students of material changes. Students are responsible for complying with the regulations, policies and procedures in force from the date they become effective, unless La Xenia expressly states otherwise.

Immigration and Visa Requirements

Students are responsible for complying with all applicable immigration and visa regulations throughout their period of study. Where a student requires a visa or residence permit, it is their responsibility to obtain and maintain the appropriate immigration status for the duration of their programme.

Upon receipt of the required fees and supporting documentation, La Xenia will provide the necessary enrolment documentation to support a student’s visa application where applicable.

Students must immediately notify La Xenia of any changes to their immigration status or visa application.

La Xenia reserves the right to refuse or withdraw an offer of admission where there are reasonable grounds to believe that an applicant does not intend to participate in their programme of study or is otherwise unable to meet the requirements of enrolment.

Visa, Residence Permit and Health Insurance

Students enrolled in on-campus programmes who require a visa or residence permit are solely responsible for obtaining, maintaining and complying with all conditions attached to their visa, residence permit and any other immigration permissions required to reside and study in Switzerland.

La Xenia does not guarantee the grant, renewal or continued validity of any visa or residence permit. Any guidance or administrative assistance provided by La Xenia is offered solely as a courtesy and does not transfer responsibility from the student.

Students must comply at all times with the requirements of the Swiss Confederation, the relevant cantonal authorities, municipalities (Gemeinden), migration authorities and any other competent public authority.

It is the student’s responsibility to ensure that their visa, residence permit and any associated registration remain valid throughout the entire duration of their studies. Students must immediately notify La Xenia of any change affecting their immigration status, residence permit or legal right to remain in Switzerland.

Where a student’s visa or residence permit expires, is refused, revoked, cancelled or otherwise becomes invalid, the student may no longer be legally entitled to reside or study in Switzerland. In such circumstances, La Xenia reserves the right to immediately suspend or terminate the student’s enrolment where continued enrolment would result in a breach of Swiss immigration legislation or regulatory obligations.

Students remain responsible for ensuring that they satisfy all applicable Swiss federal, cantonal and municipal health insurance requirements. Where health insurance is included within the student’s compulsory Housing Package, La Xenia will arrange the coverage described in the applicable programme documentation; however, students remain responsible for any statutory or personal insurance obligation not satisfied by that coverage.

Students must cooperate promptly with all procedures required to activate any health insurance arranged through La Xenia and must provide any information or documentation requested by La Xenia, the insurer or the competent authorities. Where the La Xenia-arranged coverage does not apply from the student’s date of arrival, or otherwise does not satisfy a period or category of insurance required by law, the student is responsible for obtaining appropriate additional coverage for that period or requirement.

Failure to obtain or maintain the required health insurance, or failure to comply with applicable immigration, residence or insurance requirements, may result in disciplinary action, suspension of studies or termination of enrolment where necessary to comply with Swiss law or regulatory requirements.

La Xenia reserves the right to request documentary evidence of a student’s visa, residence permit, health insurance or other immigration-related documentation at any time during the student’s enrolment. Failure to provide such documentation within the timeframe specified by La Xenia may result in disciplinary action or suspension until satisfactory evidence has been provided.

Students acknowledge that compliance with Swiss immigration, residence registration and health insurance requirements is a continuing obligation throughout their period of study and not solely upon arrival in Switzerland.

Visa Delay and Late Visa Issuance

A delay in the processing, issuance, collection, activation or receipt of a visa, residence permit or other immigration authorisation is not a visa refusal and does not create any entitlement to a refund, credit, fee reduction, compensation, transfer of fees or other financial remedy from La Xenia.

La Xenia has no control over the processing times, procedures, decisions, appointment availability, document requests, administrative delays or operational practices of embassies, consulates, migration authorities, cantonal authorities or any other competent public authority.

Accordingly, La Xenia accepts no responsibility for any delay in the visa or residence-permit process, regardless of the reason for that delay.

This applies whether the delay results from circumstances outside the student’s control or from any act or omission of the student, including but not limited to:

• submitting the visa application late;
• submitting incomplete, inaccurate, inconsistent or incorrect documentation;
• failing to provide requested documents promptly;
• submitting documents that require correction, replacement, translation, certification or further verification;
• failing to attend or timely arrange an embassy, biometric, immigration or other required appointment;
• failing to respond promptly to requests from an embassy, consulate, immigration authority or other competent authority;
• delays in obtaining passports, civil-status documents, financial documents, legalisations, attestations, translations or other supporting documents;
• additional checks, investigations or verification carried out by immigration or other authorities;
• delays caused by appointment availability, administrative backlogs, public holidays, staffing issues or other circumstances affecting the competent authorities; or
• any other reason that results in the student’s visa or residence authorisation being issued later than expected.

A visa delay does not postpone, suspend or reduce the student’s financial obligations to La Xenia.

All tuition fees, Service Package / Housing Package fees and other applicable charges remain payable in accordance with the student’s payment schedule notwithstanding any visa delay.

Where fees have already been paid, no refund, partial refund, credit or reduction will be granted because the student:

• is unable to enter Switzerland on the expected date;
• arrives after the scheduled commencement of the programme;
• is unable to occupy their reserved accommodation for part of an academic residence period;
• does not use meals, health insurance, airport pickup or other components of the Service Package during the period of delay;
• is unable to attend face-to-face teaching during the period of delay; or
• otherwise receives less physical use of any service because their visa or residence authorisation was not issued in time.

Students acknowledge that accommodation capacity, services and academic resources may have been reserved or committed for them in advance and that La Xenia may remain financially liable to accommodation providers, insurers, service providers and other third parties regardless of whether the student is physically present in Switzerland.

Where reasonably and academically possible, La Xenia may permit or require a student affected by visa delay to commence or continue their studies online until they are legally able to travel to Switzerland.

Temporary online participation due to visa delay does not constitute a change of programme, change of study mode or reduction in the services contracted by the student and does not create any entitlement to a tuition reduction, Service Package reduction, refund, credit or compensation.

The student remains responsible for participating in all online classes, assessments, learning activities and other academic requirements made available during the visa-delay period.

Failure to participate online while awaiting the visa does not entitle the student to replacement classes, additional teaching, extensions, refunds, fee reductions or other compensation unless expressly approved by La Xenia or required by applicable law.

Once the visa or residence authorisation has been issued, the student must travel and commence physical attendance in Switzerland in accordance with the arrival date and instructions communicated by La Xenia and subject to any applicable immigration or cantonal requirements.

If the visa is issued too late for the student to satisfy the academic, attendance, immigration or other requirements applicable to the relevant intake, La Xenia may determine that the student cannot physically join that intake and may determine the appropriate academic arrangement, including continued online study, deferral to another academic period or another reasonable arrangement where available.

Any such arrangement does not create an entitlement to a refund, reduction, recalculation or transfer of tuition fees or Service Package fees already due or paid, except where expressly agreed in writing by La Xenia or required by applicable law.

For the avoidance of doubt, only an official visa refusal that satisfies all requirements of the Visa Applicants refund provisions may be considered under the visa-refusal refund policy. A pending application, delayed application, prolonged processing period, administrative hold, additional-document request, delayed appointment, delayed permit issuance or late visa issuance does not constitute a visa refusal.

Students are responsible for planning and commencing their visa application sufficiently early to allow for possible processing delays. Any estimated processing time communicated by La Xenia, an education agent, embassy, authority or other person is indicative only and does not constitute a guarantee of when a visa or residence permit will be issued.

Nothing in this section excludes or limits any right that cannot lawfully be excluded under applicable law.

Latest Permissible Arrival Date

Students are expected to arrive in Switzerland and commence physical attendance in accordance with the arrival date and instructions communicated by La Xenia.

For each intake or academic period, La Xenia may determine a latest permissible arrival date by which a student must be able to commence physical attendance in Switzerland.

The latest permissible arrival date may be determined taking into account academic requirements, minimum attendance requirements, the amount of teaching or other compulsory activities already missed, programme structure, immigration or residence requirements, administrative requirements and any other circumstances reasonably affecting the student’s ability to successfully and lawfully join the programme.

There is no automatic right to commence physical on-site study after the latest permissible arrival date, including where the student’s late arrival results from visa processing delays, late visa issuance, travel disruption, personal circumstances or any other reason.

Where a student is unable to arrive by the latest permissible arrival date, La Xenia may refuse the student’s late physical commencement for that intake or academic period.

La Xenia will determine the appropriate academic and administrative arrangement based on the circumstances. This may include, where available and academically permissible:

• continued temporary online participation;
• joining physical study at a later academic period;
• deferral of physical attendance to a subsequent intake;
• completion of eligible academic components online; or
• another arrangement determined appropriate by La Xenia.

The availability of any particular alternative is not guaranteed, and the student does not have an automatic right to select their preferred arrangement.

Where La Xenia permits a student to commence physical attendance after the originally scheduled commencement date but before the latest permissible arrival date, the student remains responsible for catching up on missed academic work and satisfying all applicable attendance, assessment and programme requirements.

Permission to arrive late does not constitute a waiver or reduction of academic or attendance requirements.

A student’s inability to arrive by the scheduled commencement date or latest permissible arrival date does not, by itself, create any entitlement to a refund, partial refund, credit, fee reduction or compensation in respect of tuition fees, the Service Package / Housing Package or any other amounts paid or payable to La Xenia.

Where accommodation, meals, insurance or other Service Package components have been reserved for the student, the fact that the student did not physically use those services during a period of late arrival does not create any entitlement to a refund, credit or reduction.

Where late arrival results from delayed visa or residence authorisation, the provisions concerning Visa Delay and Late Visa Issuance apply in full.

Any decision concerning whether a student may lawfully enter, reside, study or otherwise remain in Switzerland is made by the competent authorities. La Xenia’s decision that a student is academically permitted to join an intake does not constitute a guarantee or representation that the student satisfies applicable immigration or residence requirements.

Passport, Immigration and Residence Document Changes

Students are responsible for ensuring that their passport, visa, residence permit and any other immigration or identity documents required for their study and lawful stay in Switzerland remain valid and accurate throughout their enrolment.

Students must inform La Xenia promptly, and without unreasonable delay, of any change, loss, expiry, replacement or other circumstance that may affect their identity, immigration status, residence status, right to study, right to work or participation in an internship or work placement.

This includes, but is not limited to:

• expiry, impending expiry, loss, theft, renewal or replacement of a passport;
• loss, theft, expiry, withdrawal, cancellation, non-renewal or replacement of a visa or residence permit;
• any change of nationality or citizenship relevant to the student’s immigration or residence status;
• any change in civil or family status where that change may affect the student’s immigration or residence position;
• any notice, request, summons, decision, warning or other correspondence received from an embassy, consulate, Gemeinde, cantonal migration authority, police, immigration authority or other competent public authority that may affect the student’s right to enter, reside, study or work in Switzerland;
• any restriction, suspension, cancellation or other change affecting the student’s immigration or residence status;
• any change in employment or internship status where that change may affect the student’s visa, residence permit, work authorisation or lawful stay in Switzerland; and
• any other circumstance which the student knows, or reasonably should know, may materially affect their lawful presence, study, employment or internship in Switzerland.

Where requested, the student must promptly provide La Xenia with copies of updated or replacement documents and any relevant official correspondence or evidence reasonably required for La Xenia’s academic, administrative, accommodation, compliance or reporting purposes.

Students must also cooperate promptly with any reasonable request from La Xenia relating to their immigration or residence status, including providing documents, confirmations or information required by La Xenia or a competent authority.

La Xenia is not responsible for monitoring the expiry dates of a student’s passport, visa, residence permit or other immigration documents and is not responsible for reminding the student to renew, replace or update such documents. Responsibility for maintaining valid documentation and lawful immigration and residence status remains with the student at all times.

Failure to notify La Xenia of a relevant change, failure to provide requested documentation, or failure to maintain the documentation or authorisation required for lawful study or residence may result in administrative or disciplinary action and, where necessary, suspension or termination of physical attendance, accommodation, internship participation or enrolment, subject to applicable law and the requirements of the competent authorities.

Where La Xenia becomes aware that a student may no longer have a lawful basis to remain, study or participate in an internship in Switzerland, La Xenia may take such reasonable administrative action as is necessary to comply with applicable law and the requirements of the competent authorities.

La Xenia does not determine a student’s immigration status or right to remain in Switzerland. Such decisions are made exclusively by the competent authorities.

Any costs resulting from the loss, expiry, replacement, renewal or change of the student’s passport, visa, residence permit or other immigration documentation — including application fees, replacement fees, travel, translation, certification, legalisation, temporary accommodation or other related expenses — are the student’s responsibility unless otherwise required by applicable law.

Service Package / Accommodation Package

For the purposes of these Terms and Conditions, the terms Service Package, Accommodation Package, Housing Package, and any substantially similar term used in La Xenia marketing materials, programme information, invoices, offer letters or other communications refer to the same package of residential and related services, unless expressly stated otherwise in writing by La Xenia.

The Service Package applies only during designated academic study periods for which the student is required to reside in La Xenia-designated student accommodation.

Services Included

The Service Package includes the following:

Accommodation
A bed in a dormitory, student residence, student housing facility or similar accommodation designated by La Xenia during the applicable academic study period only.

The Service Package does not provide accommodation during internship, work-placement or other officially designated non-residential periods. During such periods, students must reside in accommodation provided by their internship or work-placement provider, where available, or arrange other suitable accommodation themselves.

Service Package accommodation exists only for the dates expressly designated by La Xenia. Continued accommodation during holidays, breaks, internship periods or gaps is not included unless expressly confirmed.

If a student arrives early, misses the authorised airport pickup, refuses/doesn’t vacate on time, or otherwise requires hotel/temporary accommodation, all resulting costs are theirs. 

Meals
During periods in which the student resides in La Xenia-designated accommodation, the standard meal provision consists of:

• three (3) meals per day from Monday to Friday; and
• two (2) meals per day on weekends and public or academic holidays.

The meal service is intended to provide simple student meals and should not be understood as a hotel, restaurant or à la carte catering service.

Breakfast will normally consist of simple items such as cereals, bread and similar breakfast foods.

At least one meal per day will normally be a hot meal. The remaining meals are not guaranteed to be hot meals.

Drinking water is included. Soft drinks, juices, coffee-shop products, energy drinks, alcoholic beverages and other beverages are not included unless expressly provided by La Xenia. Students wishing to consume other beverages must purchase these themselves.

Snacks, additional meals, takeaway food and food purchased outside the meals provided by La Xenia are not included.

Student Participation in Meals and Housekeeping

Students enrolled in Hospitality programmes, including students undertaking Hospitality as a specialisation within another programme, may be required to participate in the preparation, organisation and service of meals as a practical component of their programme.

Such participation may include food preparation, cooking assistance, serving, kitchen organisation and related hospitality activities as determined by La Xenia.

Students residing in La Xenia-designated accommodation are also responsible for ordinary domestic cleaning and upkeep of their accommodation and shared living areas. Cleaning is not provided as part of the Service Package.

Students are expected to maintain bedrooms, kitchens, bathrooms, common areas and other shared facilities in a clean and hygienic condition and to comply with any cleaning rota or reasonable housekeeping instructions established by La Xenia or the accommodation provider.

Dietary Requirements, Allergies and Special Meals

Students must disclose any food allergy, medically required diet, religious dietary requirement or other material dietary restriction during the application and admission process, and in any event before commencing their studies in Switzerland.

Students are responsible for providing accurate and complete information regarding their dietary requirements and, where reasonably requested, supporting medical information relating to allergies or medically required diets.

La Xenia will make reasonable efforts to accommodate disclosed dietary requirements. However, special meals are provided principally where required for genuine medical or religious reasons.

Examples may include gluten-free meals for a student with coeliac disease or other medically substantiated dietary restrictions.

Students may not independently change their registered meal category after arrival. Any request to change a dietary arrangement must be submitted to La Xenia and is subject to prior approval.

Personal preferences alone do not create an entitlement to a special meal or alternative menu.

For religious dietary requirements, including requests for halal meals, La Xenia may provide a vegetarian alternative. La Xenia does not guarantee the availability of halal-certified meat or other specifically certified religious food products.

La Xenia cannot guarantee an entirely allergen-free environment, particularly where kitchens or dining facilities are shared. Students with serious or potentially life-threatening allergies must notify La Xenia before arrival and remain responsible for following appropriate medical advice and carrying any prescribed medication.

Health Insurance

The Service Package includes the health insurance arranged by La Xenia for the applicable academic study periods only, subject to the terms, conditions, coverage limits and exclusions of the applicable insurance policy.

Health insurance provided through the Service Package does not cover internship or work-placement periods unless expressly confirmed otherwise in writing.

During internship, work-placement or other periods not covered by the La Xenia-arranged insurance, students are responsible for obtaining and paying for any health, accident or other insurance required by law, by the internship provider or by their individual circumstances.

Students must cooperate with La Xenia and the relevant insurer and provide all documentation and information reasonably required to arrange or maintain insurance coverage.

Airport Pickup

The Service Package includes one airport pickup upon the student’s first arrival in Switzerland for the programme.

Airport pickup must be arranged in advance with La Xenia and is available only in accordance with the arrival procedures and scheduling instructions communicated by La Xenia.

La Xenia may coordinate and group the arrival of several students for transportation purposes. Students therefore acknowledge that airport pickup is not necessarily an individual or immediate transfer service and that reasonable waiting time may be required while other scheduled students arrive.

Students must provide correct flight and arrival information within the deadline specified by La Xenia. La Xenia cannot guarantee airport pickup where a student fails to provide the required information, changes their travel arrangements without adequate notice, arrives outside the authorised arrival period or otherwise fails to follow the communicated pickup procedure.

Unless expressly confirmed otherwise by La Xenia, additional airport transfers, transfers following holidays, personal travel, missed flights or subsequent arrivals are not included.

Services and Personal Expenses Not Included

Unless expressly confirmed otherwise in writing, the Service Package does not include:

• laundry or laundry services;
• personal or professional cleaning services;
• bed linen, sheets, duvets, pillows, towels or similar personal bedding items;
• local transportation, public transport passes, taxis or other travel expenses;
• SIM cards, mobile telephone plans, internet data plans or other personal telecommunications expenses;
• snacks, additional food or meals outside the standard meals provided;
• beverages other than drinking water provided as part of the standard meal service;
• personal toiletries;
• clothing or uniforms unless expressly stated;
• entertainment or leisure expenses;
• personal medical expenses not covered by the applicable insurance;
• accommodation or living expenses during internship or work-placement periods; or
• any other personal expense not expressly identified as included in the Service Package.

Students are responsible for budgeting for all such expenses.

Accommodation Rules: Smoking and Alcohol

Smoking, vaping and the use of electronic cigarettes are strictly prohibited inside La Xenia-designated student accommodation, including bedrooms, kitchens, bathrooms, corridors, common rooms and other indoor areas.

Smoking may take place only in areas expressly designated for that purpose, where such areas are available and where permitted by applicable law and accommodation rules.

Alcohol is not permitted within La Xenia-designated student accommodation unless La Xenia has expressly authorised its possession or consumption for a particular occasion or purpose.

Any permission relating to alcohol may be subject to specific conditions and may be withdrawn at any time.

Students must also comply with any stricter rules imposed by the relevant accommodation provider, building management or applicable law.

Conditions of the Service Package

Room and Accommodation Allocation

The Service Package guarantees the student a bed or place in designated student accommodation during the applicable academic residence period. It does not guarantee a particular residence, building, room, room size, room type, floor, location, view, roommate or number of occupants unless expressly confirmed in writing by La Xenia.

La Xenia may allocate or reallocate students between suitable accommodation facilities or rooms where reasonably necessary for operational, capacity, maintenance, safety, welfare or programme-related reasons. Such a change does not, by itself, entitle the student to a refund, reduction or compensation.

Students may not exchange rooms, beds or accommodation assignments with another student without prior permission from La Xenia.

Check-in and Check-out

Students must comply with the arrival, check-in and check-out dates and procedures communicated by La Xenia.

Students may not occupy La Xenia-designated accommodation before their authorised check-in date or after their required check-out date unless expressly authorised in writing.

Students must vacate the accommodation during internship, work-placement and other officially designated non-residential periods where La Xenia has specified that accommodation is not provided.

Upon check-out, students must remove all personal belongings and leave their accommodation and shared facilities in a reasonably clean and orderly condition.

La Xenia is not responsible for storing belongings left behind following check-out unless storage has been separately agreed in writing.

Illness, Interruption of Studies and Continued Accommodation

Accommodation provided as part of the Service Package is ancillary to the student’s active enrolment and participation in an on-site programme and does not constitute an independent or unconditional right to occupy accommodation.

Payment of the Service Package fee does not guarantee that a student may remain in La Xenia-designated accommodation for the entire originally scheduled academic residence period regardless of their academic, enrolment, disciplinary, immigration or personal circumstances.

If a student becomes seriously or persistently ill, is hospitalised, is medically unable to participate in their studies for an extended period, suspends or interrupts their studies, withdraws from the programme, has their enrolment suspended or terminated, or otherwise ceases active participation in the on-site programme, La Xenia may review whether continued occupation of the designated accommodation remains appropriate and permissible.

Depending on the circumstances, La Xenia may require the student to vacate the accommodation by a reasonable date determined by La Xenia, subject to applicable law, the student’s immigration status, medical or welfare considerations, and any requirements of the accommodation provider or competent authorities.

Where a student is temporarily ill but remains actively enrolled and is reasonably expected to resume their on-site studies, ordinary short-term illness will not, by itself, normally affect the student’s accommodation. This provision is intended to address circumstances involving prolonged illness, interruption or cessation of studies, or other circumstances materially affecting the student’s ability to continue as an active on-site student.

Where illness or another medical condition prevents a student from attending physical classes, La Xenia may, where academically appropriate and reasonably available, permit the student to participate temporarily online. Any such arrangement is at La Xenia’s discretion and does not automatically change the student’s programme or enrolment status.

Illness, hospitalisation, medical absence, suspension, interruption or other non-use of the accommodation or Service Package does not create an entitlement to a refund, partial refund, credit, fee reduction, compensation or transfer of the Service Package fee for the period during which the student does not use the accommodation or any other component of the Service Package, except where required by applicable law.

If the student’s entitlement to occupy the designated accommodation ends under this provision, the student is responsible for arranging and paying for any alternative accommodation, travel, storage, meals, transportation and other resulting personal expenses, unless La Xenia expressly agrees otherwise in writing.

Where the student’s visa, residence permit or other immigration status is connected to their studies or accommodation, the student remains responsible for complying with all requirements imposed by the competent authorities. La Xenia cannot guarantee that a student who interrupts or ceases physical studies will be legally entitled to remain in Switzerland.

Nothing in this provision requires a student to leave accommodation where doing so would be contrary to applicable law or a binding requirement or decision of a competent authority.

Personal Property

Students are responsible for their own money, documents, electronics, clothing and other personal belongings.

La Xenia does not accept responsibility for loss, theft or damage to personal property except to the extent that liability cannot lawfully be excluded.

Students are responsible for obtaining personal property or contents insurance if they consider such coverage necessary.

Damage, Loss and Additional Cleaning

Students are responsible for damage, loss or excessive cleaning costs caused by them, their visitors or their misuse of the accommodation, furniture, equipment or facilities, excluding reasonable wear and tear.

La Xenia may charge the student for the reasonable cost of repairing or replacing damaged or missing property or for additional cleaning required as a result of the student’s conduct.

Where responsibility for damage to a shared area cannot reasonably be attributed to a particular individual, La Xenia may investigate the matter and take appropriate action in accordance with its applicable accommodation and disciplinary procedures.

Guests and Visitors

The student’s allocated accommodation is for the use of the authorised student only.

Students may not permit another person to reside or stay overnight in their allocated room or accommodation unless expressly permitted by La Xenia or the relevant accommodation provider.

Visitors must comply with applicable accommodation rules and may be restricted to designated areas or visiting hours.

Students are responsible for the conduct of their invited visitors while on the premises.

Absence from Accommodation

Temporary absence from the designated accommodation, including personal travel, visits to family or friends, holidays taken outside officially designated non-residential periods, hospitalisation or other absence, does not entitle the student to any refund, credit or reduction of the Service Fee.

Students may be required to inform La Xenia of overnight or extended absences for safety, welfare, immigration or administrative purposes.

Unused Services

The Service Package is provided and priced as a package and not as separately purchased individual services.

Except where expressly stated otherwise in these Terms and Conditions or required by applicable law, a student is not entitled to a refund, credit, substitution or reduction because they choose not to use, or are temporarily unable to use, any individual component of the Service Package, including accommodation, meals, airport pickup or insurance.

Individual components of the Service Package have no separately refundable cash value.

Student Responsibilities

Students are responsible for maintaining reasonable standards of personal hygiene, cleanliness and respectful conduct within the accommodation.

Students must respect other residents, staff, neighbours and accommodation providers and must comply with reasonable rules concerning noise, security, fire safety, kitchens, shared facilities, waste disposal and use of the premises.

Students must not intentionally or negligently interfere with fire alarms, smoke detectors, emergency equipment, locks, security systems or other safety equipment.

Illegal drugs, unlawful substances and unlawful activities are prohibited within La Xenia-designated accommodation.

Serious or repeated breaches of accommodation rules may result in disciplinary action in accordance with La Xenia’s applicable policies.

Operational Changes

La Xenia may make reasonable operational changes to the delivery of the Service Package where necessary, including changes to accommodation location, room allocation, meal arrangements, meal times, airport pickup arrangements or service providers.

Where a substantially equivalent service continues to be provided, such operational changes do not by themselves create an entitlement to a refund, compensation or reduction of the Service Fee.

Keys, Access Cards and Security Devices

Students are responsible for all keys, access cards, fobs and other security or access devices issued to them in connection with their accommodation.

La Xenia-managed accommodation:
Where the accommodation is managed directly by La Xenia, a student who loses a key, access card, fob or similar access device will be charged CHF 400 per lost item.

Where the lost item is a master key, security key or other access device whose loss reasonably requires locks, cylinders, keys, access systems or other security components to be replaced, reprogrammed or otherwise secured, the student will be responsible for the full actual cost of the necessary security measures, where this exceeds CHF 400.

Accommodation provided through a third party:
Where La Xenia arranges or contracts student accommodation through an external accommodation provider, landlord, residence operator or other third party, the student will be responsible for the full amount charged to La Xenia by that third party as a consequence of the student’s loss of a key, access card, fob or other access device.

In addition to the amount charged by the third party, La Xenia will charge the student a CHF 100 administration and service fee for handling the loss, communication with the accommodation provider, payment arrangements and replacement process.

Accordingly, charges imposed by an external accommodation provider are not limited to CHF 400 and may include the cost of replacement keys, locksmith services, replacement or reprogramming of locks or cylinders, replacement access cards, security-system changes or any other reasonable security measures required by the accommodation provider.

Students must report any lost or stolen key, access card, fob or other access device to La Xenia immediately upon becoming aware of the loss.

Students may not copy, duplicate, lend, transfer or provide their keys or access devices to another person without prior authorisation from La Xenia or the relevant accommodation provider.

Removal from Compulsory Accommodation and Continued On-Site Study

Where residence in La Xenia-designated accommodation is a compulsory condition of the student’s on-site programme during an academic residence period, the student’s entitlement to participate physically in the on-site programme is ordinarily conditional upon their continued eligibility to reside in that accommodation.

If a student is removed from, excluded from or required to vacate designated accommodation because of serious misconduct, repeated breaches of accommodation rules, material safety or security concerns, serious disruption, damage, unlawful conduct or another sufficiently serious breach of these Terms and Conditions or applicable accommodation rules, the student does not thereby acquire a right to arrange private accommodation and continue physical on-site study.

Removal from compulsory designated accommodation will ordinarily result in the student being unable to continue physical on-site participation for so long as the compulsory residential requirement applies, unless La Xenia expressly approves an alternative accommodation or study arrangement in writing.

La Xenia is under no obligation to approve privately arranged accommodation or to provide replacement accommodation to a student who has been removed from designated accommodation because of their own conduct.

Where La Xenia does approve alternative accommodation, such approval may be subject to conditions concerning suitability, location, safety, immigration compliance, programme participation or other reasonable requirements.

Removal from accommodation does not necessarily terminate the student’s academic enrolment.

Where academically appropriate, operationally feasible and legally permissible, La Xenia may allow the student to continue eligible academic components online. Any decision to permit online continuation is at La Xenia’s discretion and may be subject to programme, regulatory, attendance, disciplinary and immigration requirements.

Temporary or continued online participation following removal from accommodation does not entitle the student to a refund, partial refund, credit, reduction, recalculation or transfer of tuition fees or Service Package fees.

Where continued physical participation is not approved, the student is responsible for all resulting travel, temporary accommodation, private accommodation, meals, transportation, storage and other personal expenses.

If the student’s visa, residence permit or other immigration status requires physical study, designated accommodation or compliance with any other condition affected by the student’s removal, the student remains responsible for complying with the requirements of the competent authorities.

If the student is no longer legally entitled to remain in Switzerland, the student must comply with the requirements and decisions of the competent authorities, including leaving Switzerland where required. La Xenia does not determine or guarantee the student’s continuing right to remain in Switzerland.

Nothing in this provision requires La Xenia to permit continued on-site or online study where suspension, termination or expulsion is otherwise justified under the disciplinary provisions of these Terms and Conditions.

Students Requiring a Visa or Residence Authorisation

Where a student’s right to study or remain in Switzerland is subject to a visa, residence permit or other immigration authorisation that requires the student to maintain approved or designated accommodation, removal from La Xenia-designated accommodation may affect the student’s ability to lawfully remain in Switzerland.

Where the student cannot lawfully remain in Switzerland without the designated accommodation, the student will be required to leave Switzerland and return to their home country, or another country in which they are legally entitled to reside, until they have independently secured alternative accommodation acceptable to the competent authorities and satisfied any other applicable immigration, residence or cantonal requirements.

La Xenia is not responsible for securing replacement accommodation for a student who has been removed from designated accommodation as a consequence of the student’s misconduct.

The student is responsible for all costs arising from their removal, including alternative accommodation, transportation, flights, insurance and any immigration or administrative costs.

Students Not Requiring a Visa

A student who is legally entitled to remain in Switzerland without the La Xenia-designated accommodation may, subject to applicable law and the requirements of the competent authorities, temporarily reside in a hotel, hostel or similar lawful short-term accommodation for a maximum period of seven (7) days following removal.

During this period, the student is responsible for independently securing suitable longer-term accommodation that satisfies any requirements applicable to their studies and residence in Switzerland.

La Xenia is not responsible for identifying, arranging, inspecting, approving, guaranteeing or paying for such replacement accommodation, except where confirmation or approval by La Xenia is expressly required by the competent authorities.

The seven-day period is not guaranteed and applies only to the extent permitted by applicable law and the competent authorities.

Cantonal and Immigration Requirements Take Priority

All accommodation arrangements following disciplinary removal remain subject to applicable Swiss federal, cantonal and municipal requirements and to any instructions or decisions of the competent immigration, residence, education or other authorities.

Where an authority imposes a requirement, deadline or restriction different from anything stated in these Terms and Conditions, the requirement or decision of the competent authority takes precedence.

La Xenia may therefore require a student to leave accommodation or Switzerland earlier than otherwise contemplated by this section where necessary to comply with instructions from a competent authority.

Conduct Outside La Xenia Premises

Students are expected to conduct themselves lawfully and responsibly not only while attending classes or residing in La Xenia-designated accommodation, but also outside La Xenia premises where their conduct has a material connection with their studies, the La Xenia community, student accommodation, or their status as an international student.

La Xenia may investigate and take disciplinary action in relation to conduct occurring away from La Xenia premises where the conduct materially affects, or creates a material risk to:

• the safety, welfare or rights of another student, member of staff or other person connected with La Xenia;
• the safety, security or proper operation of student accommodation;
• the La Xenia student community or learning environment;
• La Xenia’s ability to provide or operate its programmes or student services;
• the student’s compliance with applicable visa, residence, immigration or other legal requirements; or
• the safe and orderly operation of La Xenia or activities connected with the student’s programme.

Conduct that may fall within this provision includes, without limitation, violence or attempted violence, threats, harassment, bullying, stalking, theft, serious disorderly behaviour, deliberate or reckless damage to property, dangerous behaviour, unlawful possession or use of prohibited substances, and other serious unlawful or criminal conduct.

The fact that conduct occurred outside La Xenia premises, outside teaching hours, during a weekend or holiday, or in privately arranged premises does not prevent La Xenia from taking disciplinary action where there is a sufficient connection with the matters described above.

Any disciplinary action will be determined in accordance with the applicable disciplinary procedures and the seriousness and circumstances of the conduct.

Continuation of Studies

Removal from student accommodation does not automatically terminate the student’s enrolment unless the conduct giving rise to the removal also results in suspension, dismissal or expulsion from La Xenia.

Where a student remains academically eligible to continue their programme but cannot secure suitable accommodation in Switzerland, La Xenia may permit the student to complete the remaining eligible part of their studies online from their home country.

Continuation online is not an automatic right and is subject to approval by La Xenia, the programme being capable of online delivery, any applicable regulatory or academic requirements, full payment of all tuition and other amounts due, and the student’s continued compliance with La Xenia’s academic and administrative requirements.

A change from on-campus to online study resulting from disciplinary removal from accommodation does not create an entitlement to a refund, reduction or recalculation of tuition fees or previously incurred Service Fees.

Nothing in this section prevents La Xenia from taking separate disciplinary action, including suspension or expulsion, where justified by the student’s conduct.

Emergency Contact and Welfare Intervention

Students are responsible for providing La Xenia with accurate and current emergency contact information and for promptly notifying La Xenia of any change to those details.

Where La Xenia reasonably believes that there is a serious or urgent concern regarding a student’s health, safety or welfare, La Xenia may take such reasonable steps as it considers appropriate to protect the student or other persons.

Subject to applicable data-protection and other applicable law, this may include contacting or providing relevant information to:

• the student’s designated emergency contact;
• a parent, guardian or next of kin where reasonably appropriate;
• emergency, ambulance, police or rescue services;
• hospitals, doctors or other medical or healthcare providers;
• the student’s accommodation provider or authorised accommodation personnel; and
• competent public, immigration, welfare or other authorities.

Where reasonably necessary in an emergency or serious welfare situation, La Xenia may take such action without obtaining the student’s prior consent where obtaining consent is not reasonably practicable or where immediate action is reasonably considered necessary for the protection of the student or another person.

Any disclosure of personal information under this provision will, as far as reasonably practicable, be limited to information relevant and necessary for addressing the particular health, safety or welfare concern and will be handled in accordance with applicable data-protection law.

La Xenia’s ability to take reasonable welfare measures does not make La Xenia responsible for monitoring students continuously, supervising their private activities, guaranteeing their personal safety, or providing medical or emergency services.

Students remain responsible for seeking appropriate medical, emergency or other professional assistance when required.

Room Inspections and Access to Accommodation

La Xenia, the accommodation provider and their authorised staff, contractors or representatives may access student bedrooms, accommodation units and associated areas where reasonably necessary for the management, safety, maintenance and proper operation of the accommodation.

Reasonable access may include, but is not limited to:

• routine inspections of cleanliness, hygiene and the condition of the accommodation;
• checking compliance with accommodation, health, safety and fire-safety requirements;
• investigating suspected damage, misuse or unauthorised alterations;
• investigating reasonably suspected serious breaches of accommodation rules, including prohibited substances, prohibited items or unauthorised occupants or guests;
• maintenance, repairs, servicing, pest control or other necessary works;
• checking or responding to safety or security concerns;
• welfare concerns relating to a student or another person;
• check-in, check-out and room-condition inspections;
• requirements of the accommodation provider; and
• compliance with lawful requirements or directions of competent authorities.

For routine inspections, planned maintenance and other non-urgent access, reasonable advance notice will normally be provided where reasonably practicable.

Emergency and Urgent Access

La Xenia, the accommodation provider and authorised personnel may enter accommodation without prior notice or consent where reasonably necessary because of an emergency or urgent situation.

This includes, without limitation:

• fire, smoke or suspected fire;
• flooding, water leakage or other risk of property damage;
• gas, electrical or other utility emergencies;
• urgent maintenance;
• immediate or reasonably suspected health or safety risks;
• serious welfare concerns;
• suspected danger to a student or another person;
• serious security concerns;
• reasonably suspected serious misconduct requiring immediate intervention;
• circumstances requiring immediate protection of persons or property; or
• a lawful requirement or direction of police, emergency services or another competent authority.

A student’s absence from their room does not prevent authorised access where access is reasonably required under this provision.

Students must not obstruct authorised access, interfere with inspections or maintenance, or prevent La Xenia, the accommodation provider or authorised personnel from carrying out reasonable safety, welfare, security or operational responsibilities.

Any inspection or access under this provision will be carried out reasonably and with appropriate regard for the student’s privacy, dignity and personal belongings, subject to the nature and urgency of the circumstances.

Internship and Work Placement Conditions

Internship Placement by La Xenia

Where an internship or work placement forms part of the student’s programme, La Xenia will arrange one internship placement opportunity for the student, subject to the student satisfying the lawful requirements of the prospective employer and cooperating fully with the placement process.

The student must participate appropriately and in good faith in any application, interview, documentation, onboarding or other procedure required to secure or commence the placement.

La Xenia’s obligation is limited to arranging one suitable internship opportunity. La Xenia does not guarantee that an employer will employ a student who fails to satisfy the employer’s requirements or who fails to cooperate appropriately with the recruitment or onboarding process.

Student Preferences and Acceptance of Placement

Students do not have a right to select or demand a particular employer, hotel, restaurant, location, canton, region, position, department, work schedule, accommodation arrangement or other characteristic of the internship.

La Xenia may take a student’s preferences into consideration where reasonably practicable, but such preferences are not binding on La Xenia or the internship provider.

Where La Xenia secures a suitable internship placement for the student, the student is expected to accept and undertake that placement.

If the student rejects, declines or voluntarily withdraws from the internship arranged by La Xenia for personal reasons or because the placement does not meet the student’s personal preferences, La Xenia’s obligation to arrange an internship will be considered fulfilled.

La Xenia is not required to locate or arrange a replacement internship in such circumstances.

Student-arranged Internship

Student-arranged Internship

A student who declines the internship arranged by La Xenia may independently seek and secure their own internship.

Any independently arranged internship must be submitted to La Xenia and receive written academic approval before the student commences the internship if it is to count towards the student’s programme.

The internship must satisfy all applicable academic, practical, legal and programme requirements determined by La Xenia.

Students arranging their own internship are solely responsible for securing the internship and completing all arrangements necessary to lawfully undertake it, including obtaining any required employment authorisation, work permit, residence authorisation, cantonal approval or other permit or documentation, as applicable.

The student is also responsible for securing suitable accommodation for the internship period. La Xenia-designated student accommodation is not available to students during internship periods.

The approved internship, all permits and authorisations necessary to commence the internship, and suitable accommodation for the internship period must be secured before the end of the student’s preceding academic study period, unless La Xenia expressly confirms otherwise in writing.

Students must provide La Xenia with any evidence reasonably requested to confirm the internship, accommodation and relevant permits or authorisations.

Where a student has not completed the necessary internship, permit or accommodation arrangements by the end of the academic study period, the student has no entitlement to remain in La Xenia-designated student accommodation while waiting for those arrangements to be completed.

If the student cannot lawfully remain in Switzerland during this waiting period, or does not have suitable accommodation permitting them to remain, the student must leave Switzerland and return to their home country or another country in which they are lawfully entitled to reside until the internship, required permits or authorisations, and suitable accommodation have been secured.

Any additional travel, temporary accommodation, insurance, visa, permit or other costs arising because the student did not complete these arrangements before the end of the academic study period are the student’s responsibility.

Failure to secure an approved internship, the necessary permits or suitable accommodation does not create an obligation for La Xenia to arrange another internship, extend the student’s academic accommodation, provide temporary accommodation or otherwise assume responsibility for the student’s continued residence in Switzerland.

The student’s ability to remain in or return to Switzerland is at all times subject to their individual immigration status and the requirements and decisions of the competent authorities. Applicable federal, cantonal and immigration requirements take precedence over any information or arrangement provided by La Xenia.

Residence in Switzerland During the Internship Period

Students may remain in Switzerland during an internship period only where they have a lawful basis to do so and comply with all applicable visa, residence, employment and cantonal requirements.

A student who does not undertake an internship and who does not otherwise have a lawful basis to remain in Switzerland must leave Switzerland and return to their home country or another country in which they are legally entitled to reside.

For students holding a Swiss student visa or residence permit, rejection, loss or termination of an internship may affect the conditions under which they are permitted to remain in Switzerland.

The consequences depend upon the student’s individual immigration status and the requirements and decisions of the competent authorities.

La Xenia does not guarantee that a student will be permitted to retain a visa or residence permit after rejecting, losing or failing to undertake an internship.

Applicable federal, cantonal and immigration requirements, and any decision or instruction of the competent authorities, take precedence over these Terms and Conditions.

Termination or Loss of an Internship

Where an internship is terminated because of the student’s conduct, performance, attendance, voluntary resignation, breach of the internship provider’s rules, failure to comply with reasonable employer requirements or other circumstances attributable to the student, La Xenia is not required to secure a second internship or alternative accommodation.

The student will be responsible for independently securing another internship acceptable to La Xenia if they wish to continue the internship component of their programme.

Termination Outside the Student’s Control

An internship may occasionally be terminated or become unavailable for reasons outside the student’s reasonable control, including closure of the internship provider, operational changes, withdrawal of the position, redundancy or other circumstances that are not attributable to the student’s conduct or performance.

In such circumstances, La Xenia will assess the situation individually.

La Xenia may make reasonable efforts to assist the student in identifying temporary accommodation while the student’s situation is being resolved. However, temporary or replacement accommodation cannot be guaranteed, and La Xenia is not obliged to provide accommodation from its own designated student housing during an internship period.

Any temporary accommodation secured may be subject to additional charges, third-party terms and availability. Unless expressly confirmed otherwise in writing by La Xenia, the student remains responsible for the cost of such accommodation and associated living expenses.

Assistance with temporary accommodation does not constitute a guarantee that the student will be able to remain in Switzerland for the remainder of the internship period.

Where Accommodation Cannot Be Secured

Students are required to have accommodation appropriate to their individual immigration and residence status while remaining in Switzerland.

If an internship ends and the student consequently has no suitable accommodation in Switzerland, and suitable temporary or replacement accommodation cannot be secured within the period permitted by the competent authorities, the student must leave Switzerland and return to their home country or another country in which they are lawfully entitled to reside.

This requirement applies even where the loss of the internship was entirely outside the student’s control.

La Xenia cannot guarantee that a student whose internship has ended will be permitted to remain in Switzerland. The effect on the student’s visa, residence permit or other immigration status depends on the individual student’s circumstances and the requirements and decisions of the competent authorities.

Applicable Swiss federal, cantonal and municipal requirements, together with any instruction or decision of the competent authorities, take precedence over these Terms and Conditions.

Effect on the Internship Component

Where an internship ends through no fault of the student, La Xenia may, where reasonably practicable, make reasonable efforts to identify another suitable internship opportunity. La Xenia does not guarantee that a replacement internship will be available or secured.

Where no replacement internship can reasonably be secured, the student may be required to discontinue the physical internship component and leave Switzerland.

Where academically and regulatorily permissible, La Xenia may allow the student to continue eligible academic components of the programme online from their home country.

Any such continuation remains subject to La Xenia’s approval, the programme being suitable for online continuation, full payment of all applicable tuition and fees, and the student’s continued compliance with academic and administrative requirements.

Deliberate Interference With the Placement Process

Students must participate honestly and in good faith in the internship placement process.

A student must not deliberately attempt to cause an employer to reject, withdraw or terminate an internship in order to obtain another placement from La Xenia.

This includes, but is not limited to, intentionally failing to attend an interview; deliberately behaving inappropriately during an interview or placement; intentionally providing false, misleading or incomplete information; making unreasonable demands for the purpose of causing rejection; refusing reasonable cooperation with an employer; deliberately performing improperly; or otherwise intentionally interfering with the placement or recruitment process.

Such conduct constitutes serious misconduct and may result in disciplinary action, including withdrawal of internship-placement support, suspension or expulsion from La Xenia.

Where such disciplinary action affects the conditions upon which the student is entitled to reside in Switzerland, La Xenia may take any administrative action required or permitted by law, including notifying the competent authorities where applicable. The student’s continued right to remain in Switzerland is determined by the competent authorities and applicable immigration law.

Loss of Internship Component and Continuation Online

Where a student is unable to continue the internship component and leaves Switzerland, this does not necessarily prevent the student from completing eligible academic components of the programme.

Subject to La Xenia’s approval, academic and regulatory requirements, full payment of all tuition and other amounts due, and the student’s continued satisfactory academic and disciplinary standing, the student may be permitted to complete the remaining eligible academic components online from their home country.

Where the internship component has been discontinued, cancelled or lost as a consequence of the student’s rejection of a placement, misconduct, failure to secure an alternative placement or other circumstances attributable to the student, the original internship entitlement is considered exhausted. La Xenia has no obligation to provide the student with another physical internship placement.

If the student subsequently wishes to undertake an internship, the student may apply separately for an available online internship add-on programme.

The online internship add-on is a separate service and is not included in the student’s original internship entitlement or tuition unless expressly stated otherwise.

Admission to the online internship add-on is subject to eligibility, availability, payment of the applicable additional fee and approval by La Xenia. Admission is not guaranteed.

Internship Provider and Employment Conditions

Internship providers are independent organisations and are responsible for their own employment and operational decisions.

Unless expressly guaranteed in the student’s programme documentation, La Xenia does not guarantee a particular salary, gratuities, working schedule, duties, department, staff accommodation, meals, days off or other employment condition.

Students must comply with the internship provider’s lawful workplace rules, attendance requirements, health and safety requirements, professional standards and reasonable instructions.

The student is responsible for maintaining all documents, permissions and legal requirements necessary to undertake the internship and must cooperate with La Xenia, the internship provider and the competent authorities in connection with any required administrative procedures.

Cooperation With the Internship Placement Process

Students must remain reasonably available and contactable throughout the internship placement process and must regularly monitor the email address, telephone number and other communication channels registered with La Xenia.

Students must respond promptly to reasonable communications from La Xenia and prospective internship providers and must comply with deadlines for interviews, applications, documentation, permits and onboarding requirements.

Failure without reasonable justification to attend a scheduled interview, respond to a prospective employer, provide required documentation, complete required onboarding procedures, sign or return required documentation, or report for an agreed internship start date may be treated as a rejection or voluntary withdrawal from the internship opportunity.

Where such failure results in the loss of an otherwise suitable internship opportunity, La Xenia may consider its obligation to arrange the student’s internship placement to have been fulfilled.

Students must immediately inform La Xenia if there is a genuine reason preventing them from complying with an internship-related requirement or deadline.

Concerns Regarding an Internship Provider

A student who has a genuine concern regarding the legality, safety or appropriateness of a proposed or ongoing internship must report the concern to La Xenia as soon as reasonably possible.

This includes concerns relating to serious workplace safety risks, unlawful working conditions, harassment, discrimination, abuse or conduct that may materially breach applicable employment law or the approved conditions of the internship.

Students should not abandon, resign from or deliberately disrupt an internship without first notifying La Xenia, except where remaining at the workplace would reasonably present an immediate risk to the student’s health or safety.

La Xenia will assess reported concerns and, where appropriate, communicate with the internship provider or take other reasonable steps to evaluate the circumstances.

A genuine and substantiated complaint will not be treated as deliberate rejection, sabotage or misconduct merely because the student raised the concern.

However, dissatisfaction with ordinary working conditions, location, duties, scheduling, accommodation, colleagues, management style or other characteristics that remain within the agreed and lawful conditions of the internship does not by itself entitle the student to demand another placement.

Student Availability and Communication

Students must remain contactable throughout the internship placement process and must regularly monitor the email address, telephone number and other communication channels registered with La Xenia.

Unless a shorter deadline is reasonably required by a prospective employer, students must respond to internship-related communications from La Xenia or a prospective internship provider within 24 hours on working days.

Students are responsible for ensuring that their contact information remains accurate and that they can receive calls, emails and messages relating to their placement.

Failure without reasonable justification to respond within the required period, attend a scheduled interview, provide requested documentation, complete an application or onboarding requirement, sign or return an acceptable internship agreement, cooperate with permit procedures, or report for an agreed first day may be treated as a rejection or voluntary withdrawal from the internship opportunity.

Where such failure results in the loss of an otherwise suitable placement, La Xenia may consider its obligation to arrange the student’s internship to have been fulfilled.

Students must immediately notify La Xenia where a genuine circumstance prevents them from complying with an internship-related deadline or requirement.

Internship Location, Relocation and Accommodation

Internship opportunities may be located in any part of Switzerland in which the internship may lawfully and appropriately be undertaken. Students must therefore be prepared to relocate for the duration of their internship.

La Xenia does not guarantee an internship in a particular city, canton, region or proximity to the student’s academic study location.

Where accommodation is provided or arranged by the internship provider, the accommodation is subject to the provider’s terms, availability and applicable charges.

Accommodation provided by an internship provider is not guaranteed.

Where the internship provider does not provide accommodation, the student is responsible for securing and paying for suitable accommodation for the entire internship period, together with any deposit, utilities, transport or other associated living expenses.

La Xenia-designated academic student accommodation is not available during internship periods.

Internship Start Dates and Transitional Periods

Internship commencement and completion dates are determined by the circumstances of the individual placement and may not correspond exactly with the beginning or end of La Xenia’s academic study periods.

A student may therefore experience a period between the end of academic accommodation and the commencement of their internship, or between the completion of an internship and the commencement of a subsequent academic period.

During any such transitional period, the student is responsible for securing and paying for lawful temporary accommodation, meals, transportation, insurance and other living expenses.

La Xenia does not guarantee accommodation during transitional periods.

Where the student’s immigration or residence status does not permit them to remain in Switzerland during a transitional period, the student may be required to leave Switzerland until they are lawfully permitted to return.

Independent Decisions of Internship Providers

Internship providers are independent organisations. Decisions concerning recruitment, selection, employment, scheduling, workplace management, disciplinary measures and termination are ultimately made by the relevant internship provider.

La Xenia facilitates the internship-placement process but does not control the day-to-day operations or employment decisions of an internship provider.

A disagreement between a student and an internship provider does not, by itself, create liability for La Xenia or an entitlement to a replacement internship, refund, compensation or other benefit.

Internship Salary, Stipend and Earnings

La Xenia may advertise, communicate or provide examples of internship earnings, including references to internships offering CHF 2,200+ per month. Such figures represent indicative or generally expected earning opportunities and do not constitute a guarantee by La Xenia that every student will receive CHF 2,200 or any other specific amount.

The actual salary, stipend or other compensation applicable to an internship is determined by the internship provider, the individual internship or employment agreement, applicable law and the circumstances of the placement.

Any salary or stipend communicated or advertised is a gross amount unless expressly stated otherwise.

The student’s actual take-home amount may be lower following applicable taxes, social-security contributions, insurance contributions, accommodation or meal deductions where applicable, or other lawful deductions.

La Xenia is not responsible for differences between indicative earnings used in general programme marketing and the compensation lawfully offered under an individual internship agreement.

Students will be informed of the applicable compensation and material employment conditions available to La Xenia before accepting or commencing the relevant placement.

Costs of Student-arranged Internships

A student who elects to arrange their own internship is responsible for all costs associated with doing so, including travel, relocation, accommodation deposits, temporary accommodation, permit or administrative fees, transportation, insurance and other personal or living expenses.

Approval of a student-arranged internship by La Xenia does not transfer these expenses to La Xenia.

Changing or Leaving an Internship

Students may not voluntarily resign from, change or transfer between internships without first informing La Xenia and obtaining prior written academic approval, except where remaining in the workplace would reasonably present an immediate risk to the student’s health or safety.

The fact that a student has identified another employer, a preferred location, higher remuneration, more desirable accommodation, preferred working hours or another opportunity does not create an entitlement to leave an approved internship or require La Xenia to recognise a replacement internship.

A student who voluntarily leaves an approved internship without prior authorisation may lose academic recognition for work already completed and may be treated as having voluntarily discontinued the internship component.

La Xenia is not required to secure a replacement internship in such circumstances.

Academic Requirements of the Internship

Participation in an internship as an employee or trainee and successful academic completion of the internship component are separate requirements.

Students must satisfy all academic requirements established for the internship component. Depending on the programme, these may include minimum attendance or working periods, internship reports, reflective assignments, logbooks, supervisor or employer evaluations, assessments, presentations, documentation of working activities or other academic requirements.

Completion of the employment period alone does not guarantee academic credit or successful completion of the internship component.

Failure to submit required academic work, satisfy applicable learning outcomes, complete the required internship duration or otherwise fulfil the academic requirements may result in the student failing or not receiving credit for the internship component, even where the internship provider was satisfied with the student’s employment performance.

Concerns Regarding an Internship Provider

Students must promptly report to La Xenia any genuine concern regarding the legality, safety or appropriateness of a proposed or ongoing internship.

This includes serious concerns relating to workplace safety, unlawful employment conditions, harassment, discrimination, abuse, exploitation or material departure from the approved conditions of the internship.

Students should not abandon, resign from or deliberately disrupt an internship without first reporting the matter to La Xenia and allowing La Xenia a reasonable opportunity to assess the circumstances, except where remaining at the workplace would reasonably expose the student to an immediate risk to their health or safety.

La Xenia may communicate with the internship provider, request further information and take other reasonable steps to assess a reported concern.

A genuine complaint made in good faith will not, merely because it was raised, be treated as rejection, deliberate interference or misconduct.

Where La Xenia determines that there are reasonable grounds for the student not to continue the internship, La Xenia will determine the appropriate academic and administrative response in light of the circumstances. This does not guarantee that another internship or accommodation can be secured.

Ordinary dissatisfaction with the internship’s location, duties, working schedule, accommodation, colleagues, management style, remuneration or other conditions that remain lawful and materially consistent with the approved placement does not, by itself, entitle the student to reject the internship or demand another placement.

Employment Outside an Approved Internship

La Xenia does not guarantee that a student is legally entitled to undertake paid or unpaid employment in Switzerland outside an internship or work placement forming part of, or expressly approved in connection with, the student’s programme.

The right to work may depend on the student’s nationality, visa, residence permit, immigration status, type of employment, applicable working-hour restrictions, employer requirements and the rules or decisions of the competent authorities.

Students are personally responsible for determining whether they are legally permitted to undertake any employment and for obtaining and maintaining any permit, approval or authorisation required before commencing work.

Students must comply with all applicable immigration, residence, employment, tax, social-security and other legal requirements relating to independently obtained employment.

Students must not undertake employment that:

• is prohibited or unauthorised under their visa, residence permit or immigration status;
• exceeds any applicable restrictions on working hours or permitted activities;
• interferes materially with required classes, assessments, attendance, academic activities or other programme obligations; or
• otherwise places the student’s continued lawful residence, studies or enrolment at risk.

Employment obligations do not excuse absence, lateness, failure to participate in required academic activities, failure to complete assessments or failure to satisfy attendance requirements.

La Xenia is not the employer and accepts no responsibility for independently obtained employment, including the availability or continuation of work, salary or wages, working hours, working conditions, taxation, social-security deductions, employer-provided accommodation, termination of employment, employment disputes or any other matter arising between the student and an independent employer.

Unauthorised employment or employment that materially interferes with the student’s academic or immigration obligations may result in academic, administrative or disciplinary action where appropriate.

Any immigration, employment or other legal consequences arising from unauthorised or independently obtained employment are determined by the competent authorities and remain the student’s responsibility.
